Is it fraud if you issue cheques knowing here is no funds in the account?
Does it ammount to fraud if someone issues cheques knowing there is no money in the account to cover them?

I am talking about cheques which are gaurenteed by a cheque gaurentee card so the vendor would get paid but the account on which the cheques are drawen on would go over drawen.

Does anyone have any ideas?Please only answer is you have knowedge of the UK banking system and law. Thanks

It is illegal to write a cheque knowing you do not have sufficient funds to cover payment.

A cheque is a contract in UK law and if you sign it believing it will "bounce" you are deliberately deceiving the payee, thus committing fraud.

You must have the means to honour the cheque by having the money available to you, be it an actual balance on the account or an pre-agreed credit arrangement such as an authorised overdraft.

Well in the USA it would be fraud. Also if you overdraw too often the bank may withdraw your check guarantee and you may find it hard to open bank accounts. In extreme cases I have heard of the authorities getting involved too!

Unless you have an overdraft agreement you will be breaking the banking rules and you will be heavily penalised by the bank.
You may find it impossible to ever open a bank account again or obtain credit.

If you have already arranged an overdraft facility with your bank, then no, it is not fraud, always provided that the amount of the cheque comes within that limit.

If you have not previously arranged an overdraft facility, then the bank will probably not pay, and may send you a warning letter (for which you will be charged !).

It is illegal, but it depends on wether or not you intend to permanently deprive the bank of the funds. Fraud is the act of obtaining money or services by deliverate deception, otherwise known as theft, but in order for this to be proved the bank would need to demonstrate beyond reasonable doubt that you intended permanently deprive them ofthe funds. You will have set your account straight long before they take action in that way - I hope.

Yes it is. You can't issue a cheque when you know well there's no cash in you bank account. I believe the bank will charge you for it.

I don't know anything about the UK banking system but legally, it doesn't fit into the crime of ''fraud''...probably unjustified enrichment...or something els ebut not technically fraud

I believe it's not a crime (fraud) in the UK but is illegal most other countries. If you do it it's not likely the bank, or any other bank will let you use their services in the future.
