We have been asked to take a loan to help someone with a HUGE debt. the bank will not give them any more money. The bank may give us the money. They want to know what it is for and my husband want to tell them it is for renovations which is a lie. It is illegal to lie and what sort of trouble can we get into? Also, if a bank says no to someone and we know that can we get into trouble for taking out a loan to give to them? |

Yes. It is illegal! Don't do it. If they can't get the loan, it must be for a good reason. You'll end up in trouble if caught. It's similar to buying cigarettes for minors. It could get you a slap on the wrist or worse. I don't know where you live but in my state, it's up to 100 days in jail plus a fine. |

Lying about the purpose of the loan is a little shady. But remember, if you take out the loan you are the one the bank will hold responsible for paying it back. If the bank won't give your friend a loan it is probably for a good reason. Make sure you know what you are getting yourself into. If your friend has a "huge" debt, are you 100% sure they are going to pay you back? What have they done to keep themselves from getting back into debt? |

Once you are given the money, it is yours unless the there is a LEIN on the property that the loan is given on.
BUT, it would be STUPID to loan money to someone who can not pay it back. |

If it's illegal or not is not the question you should be asking yourself. The question is, will they ever pay? Being a retired bill collector for 35 years, I can almost guarantee you will be gaving them a gift! Better to say no now than to be sorry later. |

YOU actually take the loan out, if you give it to your friends thats not the banks problem. if your friends dont pay you back, you will have to pay back the loan, your friends wont have any legal obligation to. Its all on you. Its a REALLY REALLY bad idea, it could affect you friendship and relationship not to mention financial stability. Unless you are really really loaded, dont do it. |

Is it right to lie? Should you have to and maybe the bank is wise in not giving the person money. Not trying to sound cold but maybe you should REALLY think this one through. If you have to go to court to get this person to pay you what are you going to tell the judge. Don't ruin your credit because of someones ruined credit. |

I don't see why it would be. After all, as long as the bank gets their money back they will be happy... and you are free to give your money to whoever you want.
I'd say figure out something you need to do, then give the money for it to your friends, then take out the loan to do it =] |

MAKE SURE YOU HAVE A CONTRACT IN WRITING, NOTARIZED AND CHECKED BY A LAWYER. IT IS THE SAFEST THING FOR EVERYONE INVOLVED. |

Not illegal, but highly inadvisable. You do realize that you will be responsible for the loan, and must repay it. If this person cannot get a loan for himself, how can he repay you? Are you having him sign a promissory note? A good idea, even among relatives and friends. |
