Unfortunately banks charge ridiculous amounts of money! We get charged £35 if a payment has been rejected, or £25 if we have gone over our overdraw limit.
What is true is that it is considered unlawful for a bank to charge more than £12. Therefore if you find a good company to use, you can claim a lot of your charges back from your bank. We're about to go through the process of doing this with Alliance & Leicester... It's a pain, and you pay a percentage to the company you use, but I'd rather they have part of the money than the bank keep it! xx |

It is illegal for banks to penalise you with charges, they can only make their money back.
The guideline amount is £12 but if you can show their costs were less than this (which they almost certainly are) the bank would still have to pay up.
However it will take a while to get any money out of them, you normaly have to have a court date set before they pay up. |

In theory, yes. The Office of Fair Trading in the UK has said that any charges above the cost to the bank of dealing with your situation is a 'penalty' and as such is illegal. £12 is the upper limit that they think a bank can legally justify - the usual cost to the bank is about £4.50.
You can apply to your bank for a break-down of any charges imposed on your account over the last 6 years, then ask them to amend them, or threaten to take them to the County Court. The bank can charge you - normally £10 - for this service.
In theory it is fine. There are plenty of advice sites on the net - something like 'excessive bank charges'. If the charges work out in the hundreds of pounds bracket, then it is worth doing. But the companies that recover charges on your behalf say it is not worth their while for charges less than £500. And going it alone is a bit of a bind. Depends on the charges imposed.
Look on the internet, then make your own mind up whether it is worth it.

The banking Ombudsman has stated that a charge of £12.00 as a maximum is fair. Anything over that cost is unfair unless they can prove that their costs were greater than that sum. This is not just banks but all financial institutions including mortgage companies and credit card companies.
The banks, etc, can, in actual fact, charge you what they like - but you have the option of telling them that you regard it as unfair and that if they don't refund the difference then you will take the matter to court. You can do this for the unfair charges for up to six years, I believe. I think that you will find that they will pay up!

no, it's not true. the bank CAN and Do charge pretty much what they like.
However, by law they are only supposed to charge a reasonable amount to cover costs, which worked out by a bank omnibudsman is around £4.50.
so if you want to claim back all those extra charges go to this site. |

While its not illegal to charge you more the bank has to justify the charge. Request a copy of all the charges you have received in the last 6 years along with exactly what they were for, then request a refund. Whilst they will make it difficult for you and use the official complaints procedure to make it a long drawn out affair, they will refund usually claiming its a goodwill gesture. If however your account has ever gone into serious problems and they've used a collections agency then you wont get a penny. Good luck! |
