Rae | Know anything about money?? I need some advice!!? |
I have recently split from my husband and have been left with a lot of bills. I am really struggling - my outgoings equal my salary so I have had to take on a bar job too. This means working 65-70 hour weeks just to survive. I have been doing this for a while now and am starting to really feel it. I am run down and have conjunctivitis. I cannot keep working these hours because they are making me ill!
The two problem monthly bills I need advice on are my car finance, £250 a month for another 2 years (I have never missed a payment) and my old overdraft, £60 a month for about 3 years (I have missed a couple of payments and they're starting to get nasty!). I would need about £10,000 to pay these off outright.
Without getting a loan (my credit rating is rubbish) or extending the payments (want it over and done with) how can I sort this out without working extra hours or adversly affecting my credit rating? Getting my ex to pay anything is out of the question. Additional Details I'm a bit confused, I was under the impression that it was illegal to sell a car that has outstanding credit on it... |

Are any of the bills in both of your names? If yes, I would think you have a legal right to demand he pay some of them. You probably have to go to court or domestic relations for help on that (I don't know how alimony or anything like that works in UK-sorry). Possibly take in a roommate to share rent-that would help. |

You have been given good advise ( go to your local CAB )
if anyone can help you , they will
As you say , you have spilt from your husband , are any of the bills down to him , but saying that the CAB will work that one out for you.
You state that your ex paying is out of the question , well he might not want to , but if any of the bills are down to him he won't be able to avoid paying as they are his |

Contact your lenders and ask them to reduce your payments.. i work for lloyds tsb.. and if you have financial difficulties.. if you let them know they will come to a repayment plan, without affecting your long term credit score..as long as you show that you are willing.. as responisble lenders they have to take your circumstances into account... if you are really finding things difficult.. you can ask for any interest to be frozen.. and just repay what you actually owe. |

It is illegal to sell your car if it has money outstanding but if you can raise enough in the sell to completely pay off the finance you could get away with it.
You need to see a proper debt advisor- not one who offers to consolidate debt either. You can consult this place that the government set up here in the UK www.cccs.co.uk - to help people just like yourself- they can help you reduce and eliminate debt without having to pay it. Call them - you have nothing to lose and everything to gain. Good Luck. And don't fret- life is too short- its only money. |

It is illegal to sell the car. The car is not owned by you, it is owned by the hire purchase company, who you pay installments to until the value of the car and interest, is paid off in full. At that point, title to the car passes to you and you become the legal owner.
So, possessing the car does not mean you own it. As with anything that you held but was not yours, if you wished to sell it, you would need permission from the owner.
The car is security for the debt. The owner may take it back at any point to recover what you owe them. If you obtain the owner's approval to sell it, then you may. They will likely accept if you promise to pay whatever is outstanding plus interest on the value of the car.
It is best to get advice from a financial advisor. Do you have a credit card? If not, get one and cut it up when it arrives. Having the account sitting there, never missing a repayment, (because you will never spend anything on it) will increase your credit rating.
Go to your bank and explain your situation. They may extend your overdraft, or simply become more sympathetic towards your situation and become a bit nicer. If you are open and honest about your situation, the bank will be more trusting of you because you go from someone possible morally reprehensible (as you keep borrowing what you cannot pay back) to someone who has had the honesty to turn up say "this is the situation, and I want to fix it, can you help me?" |

Financial advisers can offer you advice but they are probably going to say the same things we are. Unless your ex-husband is legally required to take some of the bills, consolidation may be your best bet if you cannot pay your bills currently and you do not want to work extra hours. It's either that or bankruptcy and I would say avoid bankruptcy if at all possible (it could make getting financial help harder in the future if you need it). You don't have many other options at this point. . . |

the obvious thing to do would be to sell your car, and if you really cannot live without one buy something cheaper. If you contact the lenders and explain the situation they would probably freeze the interest. the only other way I can think of is to rent a room to somebody while you are paying off your debts. |

Speak to citizens advice to see if they can help you ge in contact with these companies that you owe. They may agree to drop the interest of the outstanding balances and just to pay the original debt. |

you need to sell the car and pay off the outstanding balance of the car loan
keep the payments to the overdraft up to date (really important) as if they get really angry they will recall it and make you pay it in full immediately
dont miss any more payments |
