I live in an apartment, my upstairs neighbors are so loud. I've tried talking to the manager but she says that bad tenants are those who complain. The cops can't really help because they said it was the apartments responsibility to take care of the situation. I don't want to get back at them cuz i dont want to get in trouble. The manager wont let me out, so the only way to get out is to break the lease. I need $5000 to break the lease. I have fair credit, not good, not entirely bad. What can i do, or where can i get the money to get out of here! If you reccomend a loan center, please reccomend someone who takes bad credit. Thank you for all your help in advance! Maybe start recording them when they're loud, from inside your apartment, then have the landlord listen. Let them know htat if they can't do something, you will have to break the lease. & don't let them keep the tape. I think you have cause to just break the lease and move out....screw the $5,000., that's crazy. |

look up the local legal aid in your area. It doesn't matter what state you are in, that landlord is out of line. |

$5000 to break a lease!!! That is crazy! Here's what I would do - invite your neighbor over for drinks or coffee. If you befriend her, she isn't going to want to bother you because people wouldn't be so rude to a friend. I would just try to do that so that you can manage for the rest of the lease and not have to pay that ridiculous fee. |

It could just be that the apartments arent built so well and it wouldnt matter who was above you - it would be noisey. I used to live in an upstair apt and the people below us were always complaining. All we were doing was walking around and living normally. I had him walk around in our apt and I went downstairs to his. OMG it was awful - it sounded like elephants where up there. I then understood his complaint. (But it wasnt really us - it was the apt.)

You said you spoke with the apartment manager... but who owns the apartments??? Just because the apartment manager is a ***** doesn't mean you are totally screwed!!! Go above her... Go to her boss and tell them what she said to you!! Cause that is just BULL ****!! You have rights too!! And you are NOT the bad tenant..... the bad tenant is the one making all the noise... have you tried talking to other neighbors in the complex too... are you the only one being bothered by the noise?? Because if there are more people on your side then the manager should listen to you!

I've been in a simular situation before. Here's the law and what you can do (although it may vary from one state to anohter): you need to call the police and file a noise complaint, if you're within the city limits you should have the right to file and they should have to come out. after you have documention send it to your landlord or manager and request action. you may need to do this as many as three times, however, once you have it documented three times and the manager has refused to resolve the issue, legally you will be able to break your lease. although your landlord can still try to collect the lease breakage fee, they will have to take you to court and you'll have to show the judge that you made a resonable effort resolve the issue. Trust me, it will be much easier than you think.

Try checking your state or county websites for a department for renters rights or seek the advice of an attorney, which would be cheaper than buying out the lease.
Your manager is jerking you around. She is the only entity that can insist that the tenants tone it down or get out beside the police.
DO NOT approach these morons again..they sound dangerous and I've suffered the loss of a distant family member shot to death for asking a neighbor to turn down his music.
Which ever you choose be prepared to move the outcome will just create more tension and it sounds like you're dealing with a bunch of knuckle dragging Neanderthals.

Just stay there until your lease is up, meanwhile save all the money you can so you can move out when it is time. It will be alot cheaper than doing it now. |

Yea try to stay until the lease is up or get a replacement to live there to finish your lease and you can move.
whatever u do, do not spend 5k on that. also, where is this amounth coming from? is it in actual writing on your lease or the landlord is just telling you to pay him 5k to break the lease? |

Well you can either go to a loan place, get a high interest loan that you will regret, or you can have a noise off. When you are home in the day, they are probably sleeping, (whenever they are quiet) so what YOU can do, is turn up YOUR music really loud, maybe they'll get the point. Or this will make it worse. You could go get a loan, AND do this, so you can get out of your lease before they have a chance to get back at you. But I highly suggest getting the crap out of there. How crappy is a place if the manager won't do anything about the noise? Sorry bout your sucky situation. Hope you find an easy way out. |

unfortunatley this can happen at any apartment complex you live in. broom against the ceiling helps. You can try to find someone to take over your lease for you that way you dont have to come up with the money or just stick it out and dont let other people bother you. turn on the tv or music invite people over eventually you will get use to it and wont hear it anymore. and remember the more you complain the louder they may get... good luck |
