kyla | My back has charged me, do you think this is fair? what can i do? |
recently a cheque bounced in my account but i knew this was going to happen.
The cheque was one that i had post-dated for my landlord back in September as i am a student. Recently when i just happened to look over my contract i saw that the cheque was dated to go out in 5 days before my student loan was due to go in so there would not be enough money in my account to cover it.
I contacted my landlord who told me he had already put the cheque in and there was nothing he could do.
So i went straight to the bank to see if they could help. i thought they could give me a temporary extended over draught for the five days just so the cheque would not bounce but they did not want to know.
now i've been charged £25 and on top of that it is wrote in my contract that my landlord can charge me £50 admin fee for the bounced cheque!
i am so annoyed, surely if i tell the bank my situation in advance they should be able to help me!!! Additional Details p.s. sorry about the typo!!!!!!!!!!!!! |

Banks generally live & breath contracts. For most people, they tend to be VERY strict to the letter of the contract (account agreement). They're much more understanding if you have a lot of money with them.
You can try talking to both the landlord and the bank. It might not help, but it can't hurt. |

I see your point, but in fairness to your bank, if they let one person extend their overdraft 'just for a few days' then they'll pretty much have to let everyone do it. They are, ultimately, a business.
I know what it's like being a poor student- I had an horrendous overdraft a few years ago. The only answer is to simply drink less and limit your spending. Oh, and get a part-time job. A couple of week-nights (or even one night of the weekend- it'll help you curb your spending) will give you cash to play with and / or get your bank balance looking marginally healthier. As for the fine, I'm afraid you're just going to have to pay it and put it down as a life lesson- banks are w*nkers sometimes. Sorry! |

Yes, they both can charge you. Have you ever had overdraft fees before and are you a long time account holder? You could speak to a mgr and request a one time courtesy waive of this fee. This is solely up to the bank but it does not hurt to ask. Also, speak to your landlord and ask if they will waive the fee as well. |

well if you do not know how it is your fault then you should not have a bank account anyway it is unsafe |

Bad luck but life is hard, especially when dealing with contracts and business.
You did not say if you mentioned to the landlord if and why the cheque was postdated. If you did I would kindly point this out to the landlord and see if he will waive the bounced cheque fee as a gesture of goodwill.
The same goes for the bank. Rather than bury your head in the sand you tried to correct the situation/ You should remind the as a student your future banking life (I assume)has only just started, and has a long time left to run.
GOOD LUCK |

You are in the wrong, and the bank can legally charge you.
Your best bet is to make a request to the bank - in person - to reverse the charges "just this one time".
In the future, no more HOT checks! |

Yes, I understand what you are saying, but in all fairness it was your fault and no-one elses. You have to take the responsibility for your actions and not try to shift it onto someone else, namely your bank. Bank charges are not something anyone wants to pay - but we're all aware of them and there's one way to avoid them - dont go overdrawn and manage your finances more responsibly. |

postdating a check is illegal. writing a check knowing that there isn't money in the bank is illegal too. You are lucky you just got a fee and didn't end up in court like many people do. Just be more responsible with your money and you won't have to be mad at the bank. |
