Don't worry about this, its now standard practice! You need to go through to the court stage before they will refund you, as so many people are claiming.
Use the steps below, and the template letters on my site and you should have a good chance of getting a full refund of your charges. My site tells you everything you need to know, and sets you up to be in the best possible position with your claim.
The full process and timescales for claiming back your charges is:
1) Write to the bank and ask them for a copy of your charges for the last 6 years, or alternatively a set of statements for the same period. You do this by making a "Subject Access Request" under the Data Protection Act, enclosing a cheque for £10 made out to the bank. This by passes the banks normal charges for statements which is normal a large amount for 6 years worth. The bank have 40 days to send you the data.
2) Write to the bank asking them to refund your charges, giving them 14 days to reply, attaching a "Schedule of Charges" (a list of the charges you are claiming for).
3) Send the bank a "Letter before Action" giving the bank one last chance to refund your charges before you take court action. They have 14 days to reply.
4) File a claim online using the Money Claim Online web site run by the UK Court Service. The claim is served on the bank 5 days after its submitted. The bank has 14 days to acknowledge the claim. If they don't you can request a "Judgement by Default" and you win the case, and get your charges, statutory interest at 8%, and your court fees.
If they do acknowledge the claim, they then have 14 days to submit a defence (making 28 days in total from the date the claim was served). If they don't then you can again request a "Judgement by Default", and get back your charges, interest and court fees as above.
If they file a defence, then you and the bank get an "Allocation Questionnaire" to fill in. Some judges dismiss the case at this stage, as the bank can't win, so again you win. If this doesn't happen, a hearing date is allocated. The bank will most likely either back out before the hearing, or won't turn up in court. Again you win the case and get your charges, interest and fees.
Follow the correct procedures and you stand a good chance of getting your charges back! Its important to send all letters to the bank and courts by recorded delivery, so you can prove they were received, and more importantly when they were received (which you can find from the tracking section of the Royal Mail web site).
Also make sure that you send all letters to the banks head office, and not your local branch. Don't phone the bank either, as this can delay things and you have no proof of whats been said.

Theyve all started doing it. Lloyds won a court battle about it so many people are being declined. I think its a stratagy that they are using at the moment to stop people claiming them. They dont think many people will actually take them to court.
If you think you have a good case then do it.

If your bank has refused to refund your charges, then you can lodge a claim against them in court.
Check out the following links for more info. The first site gives a detailed guide on how to lodge a complain with the Information Commissioner who will force the bank to comply.
I personally am using www.moneysavingexpert.com to get my fees back. Please don't be disheartened by the recent news that people have lost their cases against banks. The charges they impose are ILLEGAL!

Go the Consumer Action Group website and follow their step by step instructions. It will take appx 3mths and just sending a letter asking for them back isnt going to work |

Proceed with the next step of issuing them with a small claims judgement from the county court. (see various websites such as MARTYN LEWIS)
I got my total claim from Nat West, after 4 months. They finally settled up before the court gave us a date. £4,390. am going to do the same thing now with Alliance and Leicester.
DON'T back down, or settle for anything less than the full amount they owe you. |

Most banks are very, very, very lenient in their refund policy. In other words, they'll typically refund your charges if you politely ask them.
The best solution is prevention (prevent the fees in the first place). Secondly, if you have a face-to-face visit with the bankers and kindly ask them they will probably refund the fee.
If all else fails and they aren't understanding and professional, you can change banks (heaven knows there's one on every corner). |

The real question here is - were the charges incurred because of your error or theirs?
If you didn't balance your checkbook and wrote checks for more money then you actually had - to bad for you. Your bank tells you when you open an account what the overdraft fee is.
If the bank made an error and penalized you for it, that needs to be refunded to you.
Banks can and do charge fees for services, penalties and whatever else they can get away with.
Banks are in business to make money, not to do you any favors. |

In my experience Bank's only give partial refunds to those customers that they want to keep ie those that they feel they will get business from in the future. The fact that they have refused yours doesn't say very much for your account conduct.
Why don't you go to your local hairdresser/take away/taxi driver/corner shop/ beauty salon etc etc and ask them to refund you for the services you have received!! See how far you get!! Freebie!!!! |

there are several letters circulating at the moment, that state that bank charges are in fact illegal and they give you some template letters to send to your bank saying that you want all your bank charges back for the length of time you have been at that bank or you will take further action (only problem is that you will no longer be welcome at hte bank after it is over) we got back over £800 from bank charges alone

Girl, I'm an expert on this one.
First call customer service, usually they will take a few charges off, document what time, day and who you talked to.
Next, go inside and speak to the branch manager, he'll usually say he'll take more off than the customer service guy. Be really nice too.
Next, send a letter explaining why and how it happened and what you would like to be done to the "claims review" department.

I am in Washington State, here we have Banks that offer free checking accounts, if you have direct deposit of your check to the bank. This saves them the expense of having a teller to take your deposit. I have my 2 retirement checks send directly to them. I have it so I go on line, and they even send out my checks for my bills, that way I save postage. If I need money I go to the ATM and get it. I doubt if I even use a teller more than 5 or 6 times a year. Ask around the banks where you live and see if any of them offer this service. In olden days all banks charged a service charge, tha has changed in the last 10 years or so. Not knowing the banks in your area I can not recommend one to you. s to getting you Service Charged refunded I really doubt you will, but by changing banks you may save getting them again.
