This is NOT a "Best Friend". I would consult with a lawyer. This person has abused your friendship and exposed you without concern for you or the friendship. They need to be held accountable for their actions. It sounds like you may be held accountable for your mistake of lending them the money. Get assistance and remember "this too shall pass". Bless you.

Maybe you can get a loan from your family. Since you didn't offer any other details, there is not much more to say.

You need to realize that your credit is much more important to your life than the friendship. Tell him you need to money now, or you will take him to court over it.

Gary
Take your friend to court. Then get a new friend. Do not ever loan or go into business with family, friends or relatives again.

If this is indeed true, you need to get a very good attorney and go to the head of the bank and spill it. You are intrusted with people's futures, you cannot betray them and look what its doing to you.

America no longer has debtors prisons, so you can't be sent to jail for owing money on a loan... you could if it was embezzled from a bank you are working at (i cant take anymore from bank). If you co-signed a loan for this person, or borrowed money for them in your name, take them to court; but if THEY don't have the money to pay you back, they aren't going to jail, all you can do is put a judgment against them and/or a lien against their cars or property.

Set up a budget that will help pay off your debts, 10% to a retirement fund, %20 to debtors, in equal shares based on amounts owed, and %70 to live on. And DONT LOAN OUT ANY MORE MONEY! Golden rule of loaning, an informal loan needs to be money that you do not expect to receive back, so if you do its a pleasent surprise, and if you don't its no shock.

michelle
first of all you took that chance when you loaned someone such a large amount of money!! Best friend or not you should have known it wasnt going to be easy for that person to pay back so much money!! why would you loan out so much? i can see like 100 but not 10000!! you may have to take this person to court but i would def let that person know first that if they dont give back the money that you will be contacting your lawyer!! warn him/her first though!!

When you're in jail, you don't need money.

You are more than likely going to need to get a lawyer involved. This is going to be costly, and more than likely, after the fees and etc., you'd probably be better off suing yourself in civil court. But this all depends on what kind of evidence you have. Also, if you take them to civil court, there is usually a statutory maximum allowed, which I've seen as high as $3,000; I'd weigh your options. If you have a steady job and checking account, try a flexcheck or short term solution. They are horrible to get involved with, but I'd imagine living pay to pay is much better than being in jail!

You really have no choice; unfortunately, no matter what you do, you will not be seeing that money any time soon.

A word of advice, choose your friends wisely. Next time a friend wants to "borrow" money, only do so if you have some to spare. If it's money that you will NEED back in the future at any point, you need to write a promissory note. A real friend would have no problem signing that if they have no problem paying you back. No signature, no money. Simple as that.

Good Luck!
