My employer taking money out of my check without my consent?
alright so, i missed one of my morning shifts at my work. When i did wake up, about an hour after i was supposed to be there, i called in and was informed that 50 dollars was getting taken out of my check to pay for one of my coworkers to cover the shift. This happens a good amount at the store, but it is usually only for about 20 dollars. In either case, it still doesnt seem lawful. which brings me to my question of if this is legal.

It is not legal for them to do that. If you are not under a salary and you are getting paid by the hour, the your employer would simply not pay you for the hours you didn't work, not take money out of the hours you worked. You need to consult a professional in the legal field for more advice. Hope this helps.

Work out how much you get paid hourly, and how much SHOULD have been deducted lawfully. Talk to your manager to see why he/she thinks she can just yoink cash out of your cheque whenever he/she feels like it, then seek professional advice with the information he/she has given you.

Assuming you work in the US and you are paid by the hour. Your employer should pay you for the hours you worked. So let's say you are an hour late for an eight hour shift. Then you should only be paid for seven hours that day.

I'm guessing this is not legal. But check with the Department of Labor.

yes it is there was a law passed in 2007 stating that if a employee fails to show up for his or her job the employer has the right to take the pay out of the next check and take a penalty fee out as well.

If you're salary and when you applied and signed paperwork, they may have had a clause in there to that effect. If your getting paid hourly, I don't think that would be legal.

The best thing is to talk to your boss/supervisor professionally, not confrontationally and ask him you're confused about that. If that does not work, then consult a lawyer or trusted friend/family member.

I've never heard of something like that in my life...reprimanded maybe, but paying a penalty??? You don't work for a credit card company do you? Just kidding.

it is probably not legal, unless you've signed something in print about this when you first got the job. the problem is that this happens to people that miss their shifts, which could be reason for the employer to take such actions. i am not a lawyer so i can't know for sure. and even if your employer is in the wrong, i am not sure if you'd bother with suing him.

for one thing, it's really expensive to even just consult a lawyer about whether if you will win this case and if the money you'd win in court would be worth anything. and it's even more expensive to actually start the whole legal grievance business. after all, you were late first, and that could convince the court otherwise. so in the end, you might end up actually losing a lot of money.

another is that you'd obviously lose your job, which seems to pay about 20 an hour so it's not so bad.

my advice is probably just try not to be late. it's hard though, i do it sometimes myself

Doesn't seem lawful to me i would say there has to be someone to report this practice and show them whats being done.I don't think you can get away with that.tons of people miss days and don't have to pay for the other people covering them.
Hope someone gives your legal rights answer...

I've never heard of anything so strange. While it's true that an employer can dock you for being late, he can't pull money out of your check to pay the wages of a replacement.

Hiring a lawyer can be pricey...who I would call instead is your state's department of labor. I'm attaching a link from the US department of Labor so you find the location of the state office. You should even be able to send them an email inquiry.

I would say it's legal for them to not pay you for time you aren't there. But exactly how they arrive at the exact dollar amount is questionable.

No, it is not legal. They should've either fire you or wrote you up. Not take your money to pay for someone to work for you. You are not the employer, you have no legal right to pay another person to cover your shift. They, as an employer should pay your other co-worker. Not you, the employee. Search the difference between an employer and employee. You'll see that they have no right to do that.

i dont know about legal, but is it not fair that you get paid for the hours that you actually work.

if you are not there, they are allowed to dock your pay. you should not be paid for time you're not working but you should figure out how much money should have been taken (hours missed times hourly pay). they cannot take more then what you would have earned.
