if no one cosigned then no one pays. Sometimes credit card companies take out life insurance on card holders that pays the balance they owe if there are no surviving cosigners. If there is an estate then they can collect from any money he leaves behind. |

His estate that he leaves will be responsible for the debt. If he leaves no estate, the credit card company will have to eat the debt unless he has a co-signer on his card..such as yourself or your mother. If no one else signed onto the card...then they cannot collect from anyone else. And it is not true the the "wife" will be responsible for his debts She will only be responsible if she put her signature on it. Wives do not inherit their husbands debts...unless they share the debt by both signing a legal document together. |

Nobody but he is responsible for the debt (unless somebody else is listed on the account). The creditor generally writes these accounts off.
I would not pay should he pass.
They may indeed sue the estate though. They probably wouldn't bother. |

Unless there was a co signer to the card it is considered your fathers debt. It would become part of the estate. But they are usually written off by the credit card company. That's what they did for a friends father. Don't worry. I am sorry about your dad. |

If they are only in his name then only his estate owes.
So if he has a home or property. They will be deducted from the sale.
If he has sold or given all personal and private property to other family members already before he passes then oh well! There is nothing to take it from. |

When someone dies, the overall estate is considered. Assets, debts, life insurance, home equity, etc. If what's left over is a positive amount, it will be passed on to the next of kin. If it's a negative amount (more debt than assets), the credit card companies will have to write off the loss.
The only way you or anyone else would be left with the debt is if you or the someone else is a co-signer on that debt. |

If you're father has any life insurance, his debt will be taken from that. If there's any left over debt after that, or If he doesn't have any life insurance, the credit card companies lose. |

Im not sure, I would seek some legal advice. Some credit cards/loans have a payment protection scheme where they will cover the outstanding amount in the event of death, unemployment,sickness etc. Does ur father have any of these policies on his cards? Does he have a life insurance policy/savings that would cover the costs?

Does your father have any life insurance? I found when my dad died, that I had to use his life insurance money to pay some debt. But, if your dad doesn't have a will, his estate will go to probate in the courts and any and all people he owes money to can claim a share of his estate. I would make sure they will is all in order and try to get everything in order now. It is a difficult process and I truly feel for you. Best wishes. |

If life insurance will pay out when he dies, then that should cover it. Otherwise, his next of kin or wife if she's still alive. You probably ought to talk to a lawyer or financial advisor. |

Your mother most likely. I know most states the bills get passed on to the spouse if they are alive. |

If you father is married, his wife will be responsible for those debts. If he is not, then the debts must still be payed from his estate. If he is completely broke and has nothing, and is not married, then nobody pays. |
