i am assuming that the girlfriends took over payments or that he has declared bankruptcy at this point, otherwise the house goes to the bank.
it is his house, regardless of who pays for it. the appreciation on the house is enough to cover the mortgage at this point. tell her to find a good lawyer. since they are not married, theres no 50/50 rule. she needs to show documentation of paying for the house and back it up with an agreement between the two of them stating that if she took over payments the house would be portioned out. simply put, she needs to prove that she wasnt 'renting' the house from him. this needs a lawyer, not yahoo answers. sorry. |

Based on my understanding of what you said, he sounds like a deadbeat who left his wife and child to fend for themselves while he went out and made some money. Now that the house has upped in value he wants back in. I hope she finds a good lawyer, proves he has done squat for an entire decade and he gets nothing. Your friend should find a new boyfriend, one who isn't a loser. |

If his name is on the deeds and the mortgage he is entitled to half the house value - however she could then counter sue him for back dated child support.
I think she needs to go to the CAB or a local family solicitor. |

I would say hes not due any more than he actually paid in. Without any allowances for inflation and so on, just the exact amount that he shelled out. He will have to sign papers to allow his name to be removed, but if he gets iffy, your friend will need a good solicitor to make sure he doesnt try and rip her off. Exes can turn into bullies sometimes. |

I think you need to get some actual legal advise, most places offer a free intial consultation.
I think if you both have your name on the deeds then you both own half, regardless of who has paid.
If you can PROVE that you have been the only one paying for the last 10 years AND that he hasn't been contributing in other ways then you should be able to take him to court if he tries to demand half.
If you started paying the mortage while he paid for food or appliances or DIY then he might be entitled anyway.
Who has custody of the child will come into it also. |
