It would seem to me that you should have the divorce court order the sale of the house, order that you keep the proceeds as partial alimony in gross, set aside as much of this as you can as "homestead" under applicable state laws. and then consult with a lawyer understanding divorce and banrkuptcy about whether bankruptcy is a reasonable option for you.

You need to consult your lawyer A.S.A.P. this will change the entire structure of your bankruptcy. It will be a lot better to get it straight now rather than trying to redo it later. |

If the man has disappeared the house is yours. If he comes back, then file for divorce and go 50/50 on everything. Chances are his 50% will continue to go to drugs and will become an even bigger looser. |

This is terrible. I can not help but feel sorry for you. Can you sell the house? I would look into that and see if you can start over. After 18 years you must have some equity. Check with social services in your area and see if they can direct you to some kind of counseling to help you through this situation. It is very involved because you are dealing with multiple difficulties. I am saying a prayer for you, unfortunately this is all to common. Be strong for your children. |

I dont think you should file bankruptcy for couple of reasons.. I deal with problems like this everyday and i would like if you could contact me, so i can give you some good advice.... I know its hard times right now but their are ways you can go about without bankruptcy...

If your in the middle of filing for bankruptcy, you cannot sell anything, because this is fraud. You need to contact the attorney handling your case before you end up in jail. |
