about 3 years. She buys everything on it and tries topays it all off at the end of the month - no check book to keep track of. She had a large car repair bill last month and was unable to make her card payment. Her credit card bill came in today and along with plenalties, her interest rate jumped to 33% from her normal 12.9. Now a 3rd of her monthly payment is interest. How can they do this and aren't there Usery Laws. What can she do? She just makes ends meet as it is and her family isn't any better off. |

Usually I don't talk about specific banks but working for Bank of America I feel inclined to answer this one. Everything is in the disclosures but here's how the gist of it works. Whenever someone is late or goes over their limit twice (1st time we let slide) their account goes into default pricing for 6 months. That means that the rate is higher. During that six months you can't be late or go over your limit and it will go back down to that 12.9%. I know it isn't the greatest thing to know but I am inclined to recommend two options: 1st being to transfer the balance to another card (you can't transfer from a BofA card to another BofA card so you'll have to do it at another institution), please note that if you do that though, even if a new card has a promotional apr most likely the rate would jump up after that because it's a transfer. If you have any questions or you want my direct work number i'll be more than happy to give it to you, all you have to do email me with the header BofA. |

IN aus I would just cange credit card companies. some will take over the debt intrest free well in aust they were adveritsing it
card companies hate to loose customers.
ring another bank explain the situation and see if they can offer a better deal
but be carefull ask financial advice i am not an expert |

Yes there are usury laws but the fed/state responsibility split allows the charging of ridiculous interest - though 33% is a bit much for me to believe.
Just give her my number and maybe we can work out a deal...
And while you're at it watch her cut up her card. |

sorry to say but she should have read the fine print. she defaulted on her agreement to pay on time, and now she has a higher interest rate because of it. some credit cards company have a 3-6 month period where everything that is charged on the card will be of a higher interest rate until she can prove that she can pay on time. its not like she's a bad customer or anything, but thats how companies make their money. they dont care bout what struggles a person has in life...they want their money. |

they probably wouldnt of added the charge to her account if she would of called them and let them know what had happened. They usually are very good about htat sort of stuff. She can still try and calll them and explain to them her situation. If its true what you are saying that she has never missed a payment etc. then that should show up in their accounts and maybe they'll take the fee off |

There are usury laws, but what the credit card company is doing is PROBABLY legal. Bank of America is a pretty big company and is supposedly watched pretty strictly by the regulators. But just because it's "legal" doesn't make it right.
However, don't blame just the CC company. Your neighbor has some responsiblity, too. What she can do is quit using credit, live only on cash, spend less than she makes, and save for emergencies. If she can't afford that, she needs to cut something out, increase her income, or figure it out somehow. Maybe she can transfer her balance. What else can she do??? |

Tell me about it. I was only nearly crying this morning in exasperation over the same thing. This is our hard earned money. These people are thieves. Evening my savings account took $20 for a fee this week. A savings account? What happened to the days you accumulated money. And one of my credit card companies has lost a few of my payments. It is so wrong! I will be waiting for the other answers as I would one day like to fulfill my dream of overseas travel, which I will never do If I keep on getting ripped off. |

not much you can do. tell her even tho its not as easy as charging everything to keep a checkbook and balance it regulary. if she keeps charging everything shell be digging herself a bigger whole. start to only use the credit card sparingly. use it only for gas for example. now that her interest rate is 33% she wont want to carry a balance. pay it off as soon as she can..... |
