Wednesday is payday for me. its bi weekly. this past wed. was supposed to be a payday, but there was a problem with the laser printer, and the payroll lady couldnt print the checks. I suggested writing them by hand since there are only 85 employees. she said no, i print them. so they said that we have to wait till next payday and just get one big check. the problem is i CANT do that. I had a cell phone bill due thursday, and how exactly can they expect me to pay for gas to get to work? Comcast is due today, and rent is due tuesday. I spoke with the GM, specifically about how am i suposed to buy gas, and food, he told me "if you are always dependant on your next paycheck, then maybe its you who is living above your means." I resent that statement, because i believe paycheck2paycheck is how you are supposed to live. it wouldnt be a problem if the company would have wrote the checks by hand. anyways... what are your thoughts and do i have a leg to stand on to sue them? Additional Details thanks to some of you who gave suggestions... I wish i COULD get direct deposit but My credit is so bad i cannot get a bank account. direct deposit would definately have helped out in this situation. what i have to do is take my check to the bank its drawn on and pay a $3 fee to cash it |

Get a paycard. Paycards are not like banks accounts so your credit will not matter. Got o ADP total Paycard and see if they will send you one. There are many other paycard companies also. Google and find them. the program is specifically designed for people who cannot get a bank account. When you take it to payroll you just give them the paycard bank number just like you had a checking account and your money will go there each payday. there is a small fee but it is cheaper than check cashing and if you lose it then they send you another one. It really does work. I should know I am a payroll manager. |

definately call the district office if there is one. bug the payroll lady daily. they cannot hold your check and the gm had zero business saying what he did. it is not his business how you spend your money or live. remind him you are not there to make friends or provide him a service for free you are there strictly for the money to survive. good luck. your GM is a jerk. |

First of all, what state do you live in? If you live in California the Labor Board has a law that states that if you are not issued your paycheck on the day that it is due your employer must pay you your hourly wage for every hour longer that you do not have your pay.
Second of all, who does your GM think he is? The way you spend your money is none of his business. The way you work is.
Third of all. It may not be the best advice, but if I was in this situation I would just deposit it in the bank. You won't be doing anything illegal. Besides, it will mroe than likely take 3 days for the check to clear unless the bank you use is the same bank the check is written from.

Wow. That's crazy that they expect you to wait until the next pay period. I'd speak to a higher up in the company and insist that they write one out by hand or arrange to have your pay directly deposited ASAP.
ETA: Payday advance - eeeeks, very high interest rate/predatory lending (I wouldn't go there) |

I believe in some states it is illegal for employer to hold your check for whatever reason, especially for another week.They should have written them by hand. That tells you how lazy people can be, does it not? I'm afraid that i would have to refuse to work until i got paid or contact a lawyer in your state and see what they have to say about it. It doesn't cost anything to get answers. Good luck! |

This is a lame company that you should probably leave as soon as you can. Who cancels a payday because their printer broke? It's most likely illegal and you can probably lodge a complaint against them with your state labor board. There will probably be repercussions, though. They'll find some reason to terminate you eventually.

yeah what they said to you was very unprofessional and not needed. The sad things is there isn't much you can do, but i think you can go to one of those places were they will cash your checks in advance. there is a downside to these places i think they will ask for certain percentage not sure.
* i recommend that if your job offers DIRECT DEPOSIT you use it b/c they actually will have your money in the bank the night before payday. in your case it would be on Tuesday night.
my mom has that and her payday is Friday but with direct deposit she will receive on Thursday night

If I recall federal law correctly, if the company states they pay thier employees every 2 weeks on a specific day, they must pay on that day. Only exception is with prior notice.
The GM was giving you advice. Living paycheck to paycheck is a sure fire way to get into more trouble. You may not be living above your means, but you certainly are not living below them.
Although you may have a leg to sue them, it is best to go through the system first. File a complaint with the workforce commission and have your co-workers do the same. |

Their rationale wasn't correct (one big check a month later), because they are using your money anyway even if paid timely (remember your check is for the two work weeks ended a week before the payday).
They have an obligation to pay you timely just as Comcast, cell phone, rent are expecting your money by the due date. It's like you're selling your employer your time and manpower, and in turn you expect to get paid timely for the services rendered.
Or else they should pay late fees like you would to your service providers. That's what I think, it never happened to me, only once, a one-day delay, but I don't live pacheck to paycheck (and by the way, your boss' comment was out of place, how you live your life and spend your earned money i none of his business). At least he could have been understanding of the personal situation his payroll created and offer a payday advance or something (loan), not out of his pocket, but some sort of arrangement for the portion of your salary that would go to pay the upcoming bills.
I have no idea if you can sue them for this. Obviously you can, but don't know how the case would be handled and the outcome.
I would suggest borrow money from friends, parents, not loan sharks. Maybe the rent can wait if you live in a small complex (maybe an IOU would work), cell phone or comcast i don't think so, they want your money when it's due, otherwise prepare to pay late fees (they should then be reimbursed by your employer, it's their fault afterall).
But at any rate, they're explanation (printer) wouldn't fly with me. Is your company in good financial standing? sometimes paycheck payment delays are a sign of a troubled company, cash flow issues., robbing peter to pay paul, isn't that the saying? |
