okay he is dumb. he had no money in his account. so a couple of times he deposited blank papers in the ATM and withdrew altogehter $250. he said he needed it right away. i told him not to do it but he did it anyway. he says he intends on paying it back though. is he going to jail?? Well NOW he really needs that cash right away to pay back the bank. The bank will show negative on his account and hit him with overdraft fees. They might even freeze his account.
If he pays the overdraft and fees right away, he'll probably get away with it. But frankly, he deserves some jail time for fraud or theft. Or at least a good scare to show him the error of his ways. |

He better go to the bank and drop to his knees and beg for them not to press fraud charges. He should go to jail, your right he is dumb, he knew it was wrong.Just let him learn his lesson the hard way. Then he might think twice before he breaks the law again. |

The bank will place a fraud alert on his account and in check systems. His account will be closed within 30days. And until he pays off the balance and the bank decides, his name will remain in chexsystems with a fraud alert. Chexsystems is kind of like a credit report for banks. When a customer opens an account we check in chexsystems to see if they have opened multiple accts, fraud accounts, etc. He may or may not be able to open another account for 5 years. Depending on if his bank keeps him in chexsystems or not. But most likely he will not go to jail for such a small amount. |

I don't know if he's going to jail or not. It depends on how smart the bank is. Usually when you make a deposit at an ATM, the money is available for withdraw right away. Once the check is received at the bank, the teller will do their normal procedures to deposit the check. If it turns out that there is an error or they cannot deposit for whatever reason, then they will debit your account for the amount of the deposit. He will eventually have a negative $250 balance that will be due.
Banks are usually very smart though. I would advise him to deposit the money into the account immediately. |

The answer depends on numerous things: How long ago did it happen? How quickly can he pay the bank back the money plus overdraft fees, etc? How long will it take the bank to track what happened?
If he's lucky, he COULD get away with it. Its possible the money could be back in the account before it was really noticed. He COULD pass it off as a "whoops, didn't realize I made the mistake... Here, let me fix it for you. My bad" thing and if the bank is in a forgiving mood they may allow him to just pay the fees, etc and let him off.
But yes, in theory, he very likely could go to jail. Its fraud, its illegal, and its downright stupid. He'd have been better off going to one of those pay-day loan, not quite a loan shark places and borrowing the money from there. |

He will probably go to jail, yes. He was stupid enough to rob an ATM using his own account numbers. Once they catch up with him he will definitely be in trouble. Nobody needs money that bad. |
