Really quick - if I file bankruptcy, can my parents lose their house?
I owe about 50K in debt, but 27K is student loans, 3K to my parents and less than 2K is taxes. meaning I would be file on about 18K. But I moved back at home. So when I get asked what my address is, I have to give the address of my parents house - which they own. I live in New York state and I work a part-time job making $8.50 an hour. And trust me, I have been looking for something better.

Are my parents at any risk of losing their home if I file bankruptcy???

This would be like the owner of an apartment block getting dinged for a tenant filing bankruptcy. If you do not own the house, the is not an asset which can be taken away from you. You don't own the neighbour's house either and thus, that can not be taken away from you savvy? Sides, bankruptcy is essentially settling with your creditors and taking up payment of the consolidated debt with another organization.

Now on the other hand, if your parents cosigned for any of your loans or outstanding debt, I would speak to a debt consultant.

As long as your name is not on their mortgage you should be good.

Andrea
Not unless you are listed as an owner of the property.

The only way they would be at risk for losing the house is if your name is on the morgage/loan/title to the house. If your name is no where on those documents, then no your parents wont lose their house, because it is theirs not yours and you are filing not them. I would talk to a lawyer, they will explain everything and make your life easier, especially if you do decide to file.

Hi,
I used "Credit Solution" to settle my debt and avoid bankruptcy. They managed to reduce my debt up to 58%.It's legitimate.I came across this company on NBC News Special Edition.Check it out here:

Are you filing a default loan in your bankruptcy that has your parents signature on it? If not I believe you will carry this debt with you and the bankruptcy. It will keep you in your parents house for sure though, cuz you wont be able to get approved for an apartment or house loan after you file. They would have to co-sign with you or actually have to put it in their name. You'd just be a burden on your parents if you file. If I was you I would buck up and get a job and consolidate these loans at a smaller interest rate and pay your debt or at least get out on your own and re-affirm on something in your name and pay your payments on time. It might take years. Don't do this to your credit or put your parents in a bind. I realize it would be easy for your debt to disappear, but it really puts a stopper on life. (DON'T DO IT) If you do have your parents on one of these loans owed to someone else in your claim, I would consult my parents first.

Even if you were on the loan- absolutely not.
If you own a car, you shouldn't even lose it. If you have a loan on it though, try to park it where it won't get repo'd (as easy) until every thing is complete (you would have to keep paying on the loan).
You probably won't lose a single possession.
Just your credit score...

Depends - are their names on any of your loans? Did they co-sign anything for you, like your student loans? If they backed you, then maybe the debtors could come after them.... Check with your financial institution and a bankruptcy counsellor.

I don't think so if your name is not on the deed. You should be able to go on line for your state or call an attorney for a free consultation to find out the laws for your state.

I dont think so. I believe they can only take what is in your name.
