It is not your money. If you spend it, then you can be liable for it. A person making an honest mistake does not magically transfer ownership of money (or any other property). The bank will sue you if you spend it. You are not required to notify the bank of its mistake (it will figure it out on its own). The bank will eventually remove teh money from your account.

This used to happen to me all the time. I had an bank account which constantly had several thousands of dollars each month deposited into it. It was an electronic direct deposit from someone with the same name (and oddly, who worked with my father) and who had an account number 1 digit differently from mine. I never had to do anything to fix it. The bank always figured it out, removed the money from my account, and creditted to the rightful owner's account.

It happen to me once it took the bank about a week to realize the mistake and then they withdrew the money. I wouldn't spend it because when they withdraw it your account might be overdrawn.

Someone needs that money. Plus you will get in trouble for spending it. Do the right thing. Your self-respect is not worth that money.

I had a friend who got what she called an "Early Birthday Present" from the bank. They figured it out later and took the money back. It'd be your best bet to just give it back to them or you might be in the hole later for it.

as an honest person it would be best for you to inform your bank and not spend the money. If it was deposited to your account as a result of an entry error the money will eventually be recouped by the bank. spending it is fraud and will result in criminal charges is you don't return it.

It's happened to me twice, and the bank always figured it out and corrected the mistake. You'd be best off to notify the bank of the error. If you spend it you will be looking at jail time, or at least some serious charges.

notify the bank and DON'T SPEND IT!!! A lot of times, the bank can tell you where a deposit came from. If it was done in error, then you can be sure that the bank will take it back. If this causes your account to be overdrawn, then the bank will charge you fees!

I've worked in the banking industry for five years. This really does happen!

call the bank, there's plenty of way for them to find out and I'm sure if they felt like it there could be legal repercussions for you knowingly spending money that's not yours.

Call the bank asap! Believe me I they WILL find the mistake... when they do your account will be debited the money and if you have already spent it this will not turn out well for you!

It's surprising how often this happens. Banks sometimes find the mistake and correct it - by debiting your account. Sometimes they don't find the problem. If you can live with the 'windfall' then say nothing and don't spend it. Leave it in your account for a year. If they haven't taken it out by then, it's yours. The bank will make an accounting correction for that sum - it's not that another depositor is without the money.
