Should we file for Bankruptcy..?
Me and my husband are at a hard time in our life.. He is struggling to pay the bills while I take care of our child and go to school. We just got a letter saying that we owe $9,300 for a car that got repossessed about a year ago. We got the car for a little over 9 thousand, paid on it for a year and it got taken away.. so the letter states that they sold it for $1,200!! which i cant believe, so now late fees + everything else we owe more than what we got it for. They are threatening to garnish his wages, which we cant live if they do. We have about $15,000 in debt including this car. We cant get approved for anything without a co signer and a lot of money. I just dont know what to do, is bankruptcy my only option? And what are the different types of bankruptcy and what would be the best kind for my situation?

p.s.. my student loans are in good standing.. we are just young and did everything the wrong way. How much does it cost to file? And can i file, what are the rules? We live in Arizona.. Thank u sooo much for ur help!

me getting a job is pretty difficult right now seeing how we have a yound child and no car and we are in debt about $15,000 like i said its not just the car. and my husband makes about $18,000 a year

Everyone goes through the tough times, it's good - for lack of a better word - that it's happening while you're young becase when you're older, you'll have had the experience. I sincerely hope you come through it for you and your husbands sake.

It's time to dig in and get after these debts. You two have made some bad choices and are going to have to suffer the consequences. What in the world were you thinking buying such a vehicle on $18,000 per year?

Your husband's income is not very good. He is going to have to deliver pizzas 5 or 6 nights a week, mow grass while trying to get a better paying job. You might have to forego school for a short time, put the student loans on hardship deferrall, clean houses and put together some income on your end too. Have family help with the child if they can.

If your housing payments (rent,mortgage) are more than 1/4 of your monthly take home pay you are probably going to need move/sell the house too.

You're going to find out what kind of a marriage you have and what you and your husband are made of regardless of bankruptcy or not. I don't think you are bankrupt. But you have a lot of sacrifice to do the next couple of years.

You will have to budget together and be accountable to one another.

Scratch together some income and get some extra money (yard sale!) and try negotiating a settlement for the outstanding car debt. If they are not willing to work with you at like 50 percent of the outstanding debt, tell them they are going into the back of the line for your debtors. They will settle with you before taking it to court. Litigation is expensive for them.

The total of your vehicles should NEVER be more than 50% of your income...EVER... oh yeah, pay only cash for them too. Car loans and leasing are where Americans destroy their ability to create wealth.

You failed to live up to your agreement, so of course the car was repossessed. You have to pay up. At wholesale auctions, the market is so glutted, I'm surprised they managed to get $1200. That's actually rather good these days.

Bankruptcy is not going to help you. It is expensive, and you will go into a 100% repayment plan, with the court taking hubby's wages and paying the bills. Of course, in addition to what you already owe, you have to pay court costs, legal fees and the fees of the bankruptcy court trustee. The court will determine how you are going to pay all this and when. And you will not be able to get any future student loans.

You have no choice but to get a job. Perhaps you and hubby can alternate your hours so one is home days with baby, then the other is home nights. Or see if a family member can help out with some child care. You cannot live on $18K! Get your butt in gear and get to work.

$9,300 is not enough money to file bankruptcy and ruin your credit for the next 7 to 10 years. Stop school for a while and get a job! They won't be able to garnish your wages if you were not a borrower on the loan.

In the meantime, pay for everything in cash until you get your debt in order, and clean up your credit. This is not an easy problem to fix, but you can fix it with time and diligence.

Seriously consider bankruptcy only if your total debts exceed $25,000. Work out a plan with the bank, who took/sold the repoed car. Chances are they are now a collection agency, who bought the original loan from the lending bank. Collection agencies tack-on outrageous amounts of interest, and charges.....just because they bought the debt from the lending bank at a discount.

Bankruptcy may wipe this debt out- but the process requires alot of court, meetings and pretty much everything you own- then belongs to the court. You cannot make ANY major purchase within those ten years- because it immediately becomes property of the court trustee. Request for a free one-hour consultation with any Bankruptcy Attorney, to determine if you guys really want this done. There is no obligation- but get more than one opinion, please. Good luck!

If you make $30,000 a year, you're not bankrupt, even with $15,000 in debts.

Go to Barnes & Nobel, and read "The Total Money Makeover".
It's an inspiring book for people in your situation.

We paid $700 for chapter seven and you need to see an attorney before you get garnished.He will tell you what is the best option for you, either chapter 13 or 7. In chapter 13 you pay the court a fixed monthly sum over 5 years. In 13 it's total bankruptcy.
