you will have to get a judgement,( small claims court), then you can file a lien, but a lein can go unsatisfeid for a thousand years,,,good luck,,,can i borrow 5000?

First, you don't need a lawyer, except in a couple of situations.

Most states allow up to $5000 claims in small claims court. You don't need a lawyer in those cases, as it's fairly informal. And many states don't even allow lawyers in small claims court.

If you are over that limit you really need one to fill out the paperwork properly.

If you have a signed note from the person, your case should be pretty open and shut. The trick is collecting.

Liens are a pain to collect on. You would be better going after other real property like a car.

If they have a job, it's even easier to garnish their wages. You can also go after bank accounts if you know where they bank at.

So a search on yahoo for "small claims court" and your state. Most have a lot of self-help information to walk you through the process.

You can only believe the advice of an attorney licensed in your state.But as a carpenter I know it is possible in many states to place a bond on a lien.As much as I don't like attorneys.You need one and will probably have to sue.

thats a matter you would have to take up in a civil suit. The judge would issue a judgement against her, and she would have so amny days to pay. If she doesn't, then its up to the judge on how to collect the money. Usually its a garnishment of wages. Ive never heard of putting a lien on personal property. You'll get your money eventually, but not without a lot of time and money invested in a lengthy court battle. I would stay friendly with her, because thats gonna be the easiest way for you to collect your money. No doubt she owes it to you.

File a complaint at your local court house and take that person to court. Or call one of the famous judges Joe Brown, Judge Mathis or my girl JUDGE JUDY. Get your money.

no you can't but you can take them to small claims court. Just go down to the court house and ask them your questions. Very, very wise of you to have a promissory note!!!!! good luck

You need a lawyer. You have the right idea, but it is not easy. If you do not get everything perfect with the court, they will slip away.

This would be based upon the laws in your state. I recommend you speak with the Circuit Court Clerk in your locality.

This is an unsecured note. Consequently you probably cannot get a lein on her house. If she in fact owns the house but has a 30 yr mortgage on it you would fall in behind the first holder. Check with your small claims court clerk for other options. The lady that told you to maintain friendly relations with your ex. has the right philosophy.
