As administrator of his estate, it is your obligation to clear up all debts (his) from the proceeds of his estate. Go to your county court house, and speak to the people in the Probate Office...they can give you some insight as to all the steps you must follow!

Good Luck! It will be a slow, complicated process, but the probate people will be the best free help...

Even if his estate has no proceeds (life insurance money, savings, etc.) you will still have to address his financial obligations...but not pay his (sole) debts with your money! If there are joint accounts, you will, personally still be responsible for those.

You do not inherit debt, like the one person claimed. But, you don't inherit assets until any claims against those assets have been cleared. If your spouse had debt, you cannot take any assets that were his alone until all of his debts have been settled, and if you had any assets that were owned jointly with him, those assets are subject to claim by his debtors. You need legal help right away. If you go spending any of his money that should have gone to pay his debts, you could face criminal as well as civil penalties.

Seek help from an estate lawyer to minimize any impact on you, since presumably you were a beneficiary of his will, if he had one.

i dont know anything in this field, but its seems logical that even if you decide not to pay...eventually the creditors will get paid by his estate by court order.

at that time his estate will owe extra fees (penalties) and interest...so if he owed it, just pay it and get it over with.

also, if he owned houses or the like, you wont be able to sell them and get the proceeds without the estate having to pay its bills first.

but again, at that point, more fees will be tacked on so you will get even less.

Yes, because his estate value is Assets - Liabilities = Net Worth. If you inherited the entire estate, you get what is left over which is Net Worth.

All his debts should be paid by his estate before any assets are distributed to heirs. You may need to contact a probate attorney, especially if there is real estate involved.

If there are no assets, send the credit card companies a letter indicating your spouse died and that there are no assets in the estate to pay bills. Include a photocopy of his death certificate (they don't need a cerified copy).

Some credit card companies will insist that you have to pay. Don't let them bully you. Unless you are in a community property state, you are not obligated to pay his credit card debts.

NOTE: Life insurance is NOT part of the estate. If you are beneficiary on life insurance policies, you do not have to use that money to pay his debts.

Unless your name is on the cards, YOU are not DIRECTLY liable for the credit cards. However, HIS share of any jointly owned assets, such as a home, IS p[art of his estate and must be used to cover his debts. If any such assets exist, you may wish to pay the credit cards in order to keep the asset.

No. If the debt is low, most creditors will except a copy or faxed copy of the Death Certificate.
Most accounts are not jointly established anymore.

Be nice and humble when you speak to them.
Just explain that you're calling to close the account due to death.

They will let you know if they'd like to sue his estate for the balance, majority of the time not.

You have credit card debt, and you wan to pay it off as quickly as you can. We will assume that you are going to stop creating more debt. You have changed your ways. You also understand that paying credit card<!--balances with a consolidation loan or rolling it into a mortgage isn't paying it off.
