My ex flatmates left the flat in october. Now there are some bills leftover from the period when they were living here, and I've been trying to get hold of one of the flatmates (i don't have the other one's number anymore) but can't get hold of her. She said she was gonna pay her share but she didnt, and now she's not answering my calls. I dont know what to do! I can't afford to pay their share too, it's almost 100 quid. I want to cry!!! What can I do?? Additional Details bills are for gas&electricity, the one left over doesn't have my number, I called them up when my flatmates left and got them to put my name on the bills startin from when they left.

If only one was responsible, that is the one who is liable. If all are responsible or any one of you, that is the one or more that pays the bills. |

Whose name are the bills in?
If yours, you have to pay. The company only has a contract to supply you. Tough.
If shared, you pay your share and it's up to the company to enforce the contract with the others.
Simple as that. Check the names. |

Small claims court, (look it up in the phone book for your nearest office) they will send you forms.
Its cheap to do and will scare your ex-flatmates into submission. |

1. Explain it to the people who are owed the money so they understand. Don't avoid them. You may have to actually pay but perhaps they will work with you, probably not.
2. Take them to small claims court. But you can't sue them until you have paid it. |

If they're in your name, you have to pay, regardless of whoever else was living there. If they aren't in your name, you don't have to pay, but you might get into difficulty if the companies terminate the service. You should call the company and try to arrange to have power and gas connected in your name from now on. That way you won't be eating cold baked beans in the dark. You might need the other person to terminate the service on your behalf.
Contact the companies that you owe money to, and tell them that you need to organise a payment plan. Tell them you are in financial difficulty and need extensions on the bills. Do this before the bills are due. As an act of good faith, make a part payment on the due date or a few days earlier (stretching the payments out to the last day they are due without penalties makes it easier to budget.)
They only want their money. If you've been a good customer and paid regularly in the past, they should be quite compliant, because they just want their money.
In the meantime, try to get another flatmate. Do checks this time. And instead of splitting it all when you get the bill, tell them they need to pay a fixed amount extra to you every week for the bills, which are in your name. If they're using your power and gas, it's only fair.
Try to cut back on your expenses. Keep the cooling and heating to a minimum. Don't use your phone. Think about terminating your internet service. Right now you need as much available funds as you can get.
Don't buy processed food, and if you work or go to university, don't buy lunch. Make it before you leave, or make a whole batch of sandwiches and freeze them. This will save you hundreds every year.
If you want some more budgeting tips, email me and I'll see what I can do. Also, check for legal advice in your area. I don't know if it'll be any good for you, but it's worth a shot. If the bills are not in your name, you might need some help to get the service established in your name, so they can't cut it off when the account isn't paid.

You might seem to be up the creek without a paddle. It is unlikely you would get anything meaningful back from your ex-flatmates. If you were to go to the Small Claims Court, they would probably offer to pay you back at £5.00 per month!
That is, of course, your emergency exit!
A letter of explanation and a suggested repayment at £5.00 per month should hold the creditors at bay. This is the normal way of delaying payment of unsecured debts.
The only problem with this is that it will not do your credit rating any good.

Call landlord right away and talk about the situation see if you can set something up... honesty is usually the best policy. 99% of the people have a heart anyway and will work somthing out with you ... if you are the primary leasee, you are stuck! track down that chick. and get your dough!!and never again mix friendship and money... never take someones word, take money first... or you end up holding the bag...sorry to say. |
