What happens if your in tons of debt and you die?
If i had around 70000 in debt and i was to die would my family have to pay for it. The only family members that are still alive is my sister and i don't really want to leave that on her.

Also would it make a difference if the person in debt committed suicide or died accidentally.

Your sister cannot be held liable/responsible for your debt.

What happens is that if someone dies without a will, the courts create an estate. They take all the things you own and either sell them, or dispose of them. Then they pay the trustee (guy appointed by the court) to pay what money you have to the debts you owe. The balance just goes away.

But, why are you considering committing suicide for $70k in debt?

The very worst thing that could happen is that you are sued and forced to file bankruptcy, but if you are not paying now, your credit already sucks.

You may be made to pay some of it back, the court looks at your wages & expenses and sets up a plan.

Money is never something worth dying for. There is always a fix and in the US, none of them involves jail or torture.

Seek help, go and talk to a bankruptcy attorney and a counselor.

I'm not trained legally, but it would be my understanding that unless your relatives are actually signed up as co-signers, or co-payers of a lending agreement, the lender would have no recourse against them. It is however; common for lenders to intimidate survivors into paying for that which they do not owe.

I hope you're not seriously contemplating suicide over a debt. There is such a thing as bankruptcy. Donald Trump has done it and bounced back, and so have countless of Americans. It is not the end of the world. Put an end to your debt, not your life. As for the debt being carried over to your sister, the answer is no, she wouldn't be responsible for it, unless you used her as a co-signer or had shared credit with her. Listen, there are many legal loopholes to get you out of debt, you just have to contact a lawyer and leave the worry to him or her. I know that $70,000 seems like alot, but there is an abundance of resources available to help you. Get a lawyer and turn to your friends for support.

Well, my husband died, but his debts were from "before" we were together. I didn't know I didn't have to pay on his debts, until about 3 years later, and was never reimbursed. None of your family would have to pay for your bills unless they were in your name "and" theirs. But the good news is that you aren't going to die accidentally or otherwise,
right? Believe it or not, we actually have options that aren't in front of our face until we "look" for them. Good luck.

Depends on what kind of debt it is. Morgage, credit card and loan usually they charge you a little life insurrance in the monthly fee to cover the debt in case of death.

It is not legal but they usually try to get it from your family. are you insured if you are then it would make a difference as to committed suicide or died accidentally. suicide they would not pay out unless it was in your clause

Sophie dude, life aint that bad, just get your dept consolidated and pay it off slowly. In the event that you happen to pass, your sister will not owe the dept, don't worry but don't just end life over 70K (if that's what your planning to do)

Only if you leave a will and an inheritance..that money would be deducted to pay the bills..but NO they will not be responsible to pay anything so stop worrying and don't even consider taking your life over money.
I'm in bad debt too but hey..find something to laugh about everyday and
maybe you could consider filing bankruptcy.
Don't let money suck the life out of you. There are many of us in the same boat as you...

They would try to go after your estate. My dad died in March, he had well over $100.000 in debt and no estate, as he was poor. The debtors call me once in a while, but I tell them he died and that send them a copy of the Death Cert, and they move on. No one has come after me or anyone else for his debts.

Depending on the debt, some will just fall to the wayside and "vanish" while many others will be someone else's responsibility. Especially if you have a will and P.O.A. Trust me, some companies will find a way to get their money.

So, yes, you risk leaving that burden on your sister. Have you considered bankruptcy?

Nonetheless, whether you like the answer or not- if you are contemplating suicide, I wouldn't do it over debt.

... OR AT ALL! Somehow, someway- you'll be okay.

(Though to be honest, it is appealing sometimes...)
