David M, of course there are people who have no estates left after death,
What about people who rent and don't own a car and no money in the bank! I have family in the same position.
Creditors CANNOT take people's clothing or TV's or furniture to pay off debts.
Also any Partners involved DO NOT have to pay debts UNLESS their names were on the debt or the debt was joint one EG bank account over draft or credit card. By law you do NOT have to pay your dead partner's debts unless there is a reason you are linked!
Married people do NOT take on certain debts like seperate credit cards etc BUT they DO inherit debts like house insurance for the house they shared or any water bills owed or any SHARED debts like joint bank accounts/credit cards/loans
My father died two years ago and was married to my mother in a shared house. Know a thing or two about rights in regards to debts.
She did NOT have to pay his credit card debts!
My mother in law passed away 4 years ago and DID NOT have ANY Estate at all! so her debts WERE written off. FAMILY members do NOT have to pay unless there is a link like shared accounts etc.
Please please get legal info from the CAB or the consumer credit counselling service BEFORE you pay anyone or do anything!
if there is NO will at all everything must go to probate to be shared out if there is any money coming from accounts or life assurance etc.
But as said before if there is NO estates to declare and this would exlcude high value items like jewelry or antiques, then there is NOTHING creditors can take!
Simple even if your married!
Please check everything before telling any creditors you will pay.
You do NOT have to pay them unless by law you have to. |

If you have no estate, any debt that is just in your name is wiped off. Debt companies might try and get money out of relatives but they are not legally obliged to pay the debt.
It is a bit trickier if you are married or have a partner as some debts might be able to be passed on to them but I would have thought that if they did not sign up for the debt it would be very difficult to force them to pay it! |

One would assume therefore that any such debts will remain recorded as unsettled. |

What do you mean there is no estate to take it from. Did the deceased live in a cardboard box? Did they have no clothing or furnishings? Did they have no vehicle? Any asset they my have had of any type is their estate and it all can be used to satisfy debts. After all debts are paid off with whatever assets the deceased had, then whatever is left goes to their heirs. |

It can be passed to a loved one to sort out, sometimes it does get wiped but not always,my friend lost her partner last year and she wasn't married but it got passed to her as common law, a partner can take the brunt of the debt if the government think its applicable, |

If you dont write a will the money goes to your family or if you have no family your children will get it and then if you have none of that it will go to the state minus whatever provision your widow needs i think but if you write them out of the will they get absolutely zilch!

My Mother has just passed away. She left no money or will just an insurance policy which was not even enough to cover the funeral costs. I went in to close her bank account and a couple of days later received a letter stating that the bank would be in touch to sort out the repayment of her overdraft, will I have to pay this?
