What if I say to my bank 'sorry I have no money I simply can't pay my debts' what are they going to do?
There are no debtors prisons anymore, I don't home a home or any possessions to speak of, I have no savings and owe £25k on my credit cards. I am self employed but my contracts have dried up because of the oncoming recession and I have failed after 21 attempts to get a job. Now I don't even have money for food. If I say to my creditors, 'sorry I simply have no money I can't give you a penny', what is the worst that they can do?????????

Wow! Tough stuff! They may require you to sign something through their lawyers that would commit you to pay as soon as you have an income, or they may write it off. In the latter scenario, your credit would be ruined, but if things are as tough as you say, it probably already is.

I sincerely hope things get better for you soon!

In the U.S. the bank would hand your account over to a debt collection agency who would then start to hound you and also destroy your credit. It also depends on what the collection laws are like in your country. I am betting it would be about the same though.

However, if you truly cannot pay then what can you do?

As long as you offer them regular payments even if it is only £5 a week for example they have to accept that...at least tehn you are paying something.

They would advise you to declare yourself bankrupt. This would mean that you would never be able to buy anything on credit EVER AGAIN. This would mean you could never buy a house/flat, or own a credit card in your life. You would never be able to own a business and would have trouble opening a bank account with a card and would probably rely on the old passbook and going into a branch. My advice would be to talk to your debtors, explain your situation and work out a payment plan with them even if it's small installments.

If you really have nothing then suing you wouldn't help them much because there is nothing the court could order you to sell. If you seriously owe much more than you have you should consider filing for bankrupcy, but that is something you should seek legal or financial advice about.

They will tell you that you need to file bankruptcy so they can get paid of by someone else. But try to stay as far away from filing bankrupt as you possibly can because it will COMPLETELY DESTROY your credit for a long time. Try to exhaust all other options first.

They can repo anything, obviously your credit probably really suck, why your probably don't own anything, and you will probably never be able to own anything..... But if I were you, I would file for bankruptcy

If you live in UK, and are eligible for benefits, then they could possibly take money out of that, i don't know for sure. They can sue you through the small claims court and perhaps get a percentage but if you have no money to speak of, ? only way would be future earning, you got me...

Go to Citizens Advice bureau. They will tell you better than anyone on here!

BUT.......

Declare yourself 'bankrupt'. That's what I would do, and your debts will have to be written off whether the bank likes it or not. You cannot trade (I believe) for 10 years, you will not get credit / loans / mortgages (I believe) for 10 years either because effectively you will have blacklisted yourself (for a while). I had a friend that did this. Life goes on though, stay positive and seek some advice asap.

I would strong suggest you get advice about an IVA, otherwise you could end up in a Bankruptcy court, you may have nothing now, if you are made Bankrupt, you will have even less, sounds weird, but true.
With an IVA you pay only what you can afford, as little as it may be, then in 5 years you are debt free.

ok, i assume you mean you dont OWN a home when you said you dont home a home. well, you must live somewhere with rent, no?

They can take your a*se to court thats what they can do. you may have to declare yourself bankrupt. and apparently then you cant get a checking account or anything, not sure what happens. otherwise they just keep charging you interest until you CAN pay.

i think declaring yourself bankrupt is what you can do.

I think that the bank are very potent at all and so if you can' t pay you may go to the prision or make society works for pay your debts.

Hey - you can stop with the victim song. YOU were the one who accrued the debt and has the money issues. I don't think they will be so sympathetic, especially since you seem to have money, but are spending it in all the wrong ways. And, if you are so broke, how in the HELL are you on the internet? You obviously have enough money to pay that bill.....

Since you want to sweep this under the rug and pretend that it didn't happen, just file for bankrupcy!
