If you knowingly spend money that you know isn't yours, you are guilty of fraud. As soon as the bank realizes the mistake, they will debit your account without warning. |

You have to pay it back. Their reasoning behind it is, you should know the amount that you have in your account. There are plenty of people that don't follow their account and kkep track. They look to see how much they have available to spend and they go by that. It sucks. |

It's the banks mistake for depositing it into your account. But it's not your money....It's someone elses. Basically, it's stealing.
I just saw an article on Yahoo this morning about a bank accidently depositing 2 million in the wrong account. The guy spent it and now he might have to go to jail. |

A personal story: Years ago, I received a check from IRS for $200., no explanation, no return address, just a check. I kept that ck on my dresser for about 6 mos., knowing it was not mine to keep. I then received a letter from IRS asking for its return, plus the interest on $200 for the period I had it. I was furious. If there had been a return address on the original envelope, it would have been mailed back instantly, and I didn't want to spend half a day dialing numbers and listening to voice messages. I knew they would finally realize their mistake and contact me. Well they did, and I paid the interest. |
