If you owe less than 40 k defiantly would not be worth it.
Get A IVA if your in England, THE CAB will be able to help you with creditors. |

My step-sister went bankrupt at around £25k, but I toughed it out when I was down £80k. It just shows that there are lots of different circumstances, which require different answers.
And IVA's are not the answer for everyone either.
Go to the Citizen's Advice Bureau - also the National Debt Helpline is pretty useful. |

The amount is not really important.
The key thing is not to worry.
Write to your debtors explaining your financial situation.
If they are not willing to help, contact citizens advice.
Some cases of bankruptcy can be removed from the register within a year.
Do act promptly and seek advice but don't allow your situation to make you depressed.
You can and will get out of it.
Good luck. |

You choose to go bankrupt when you cannot pay the sum total of all your current debts to creditors, and you cannot obtain any further credit to stock supplies, pay wages and so on. It frees you from overwhelming obligations subject to restrictions, and also makes sure your assets are shared out fairly amongst creditors.
You should consult the Government website:
http://www.insolvency.gov.uk
You should also consider alternatives to bankruptcy:
http://www.insolvency.gov.uk/bankruptcy/alternativestobankruptcy.htm
Bankruptcy is only one way of dealing with debts and you should seriously read the information contained on this page:
http://www.insolvency.gov.uk/bankruptcy/whatisbankruptcy.htm
Read the page slowly and consider your options. |

Now a day, filing bankruptcy doesn't guarantee to have all your debts erased. It will stay in your records for 7 years and 10 years in your credit reports (depending on states.) The minimum amount should depend on each case. If you have no assets, then you have nothing to lose. There is a Statue of Limitations. Over a certain number of years, 3 to 6, depending on each state, debtors can't sue anymore. |

I dont think there is a minimum but there are basic requirements, such as having sought proper advice ,and also being insolvent (more money going out than coming in )
A judge will not grant a bankrupcy order unless he thinks you have had proper advice on what you are doing and that you are aware of your options (dmp, iva etc)
Be well informed before you make a decision like this, go to cccs or an insolvency practioner they willl not charge for advice. If you do ring anyone be armed with the amounts that you owe and who to and your income and your basic living costs this will help them to give proper advice.Look at iva-info.org and at the forum a wealth of debt advice is there. I frequently post on there and would not suggest anything that I would not think could help.
I am in an iva and life is so much improved, not the answer for all but at least check all your options out.
All the best |

The minimum amount that someone can be made bankrupt is £750. I havent come across anybody who has been made bankrupt for this amount, but thats the minimum.
I would recommend seeking alternative options before considering making yourself bankrupt. If you have creditor pressure, and its them that are pressing for your bankruptcy, then id suggest getting intouch with a firm of IP's (Insolvency Practitioners) to see what they would advise.
If your situation is right, then an IVA could be the best alternative. Also, if you do take this route, and are under creditor pressure, tell the IP about it, and chances are they will apply for an Interim Order whilst they prepare your proposal for your creditors which means you have "debt related legal proceedings immunity" for a set period of time i.e no bailiffs can come and seize possesions nor can you be made bankrupt during this time.
however, if your debts are below £2K then go to your local county court and apply for an administration order.
Hope this helps |

You can declare yourself bankrupt at any time if you can't pay your debts. But it is the most serious of the options available to you. See http://www.bankruptcy-insolvency.com/
Think about and IVA as an alternative. The biggest IVA provider in the UK is Debt Free Direct, but they are a company. If you want a more independent source, try http://www.debtadvicetrust.org/ or the Citizens Advice Bureau
Other options all of the above will talk you through are Debt Management Plans (often no more interest and payments over 5 years).
Good luck with the advice and debt. |
