What rights do baliffs have to enter family property and remove possessions when you no longer live at home?
I am going through a bankruptcy and debts, Inland Revenue, council parking fines for previously owned vehicles registered to home and other family addresses. Not to mention being chased by credit card companies, mobile phone etc. to whom I also owe money.

The baliffs came yesterday and threatened forced entry and removal of possessions. My parents told them I no longer lived there and nothing was in the house belonging to me. They were told that unless they pay (which they did on this occasion) property will be removed and the onus is completely on us to prove it does not belong to me.

Clearly its a very unhappy situation to have one's family drawn into one's independent financial circumstances (brought on by a failed business venture and poor health preventing me from taking a 'regular job' although I have never, neither will claim state benefit) I am considering bankruptcy and need to confront my creditors not least to stop my family being harassed. Anyone with experience?

if it isn't your property and they try to take it your family should call the police it's theft, however they need to be able to prove it isn't your property and you don't live there or the police will be on the bailiffs side

Balliffs have no right of entry without a court order. By paying them your parents have guaranteed they will be back I'm sorry to say.

Next time your parents should call the police.

And you need to get things sorted, going bankrupt is no excuse for not paying your way.

Court appointed baliff can remove items belonging to you only, if they take anything else they are stealing.
They had no right to take money from your parents so they should ask for it back.

If they have baliffs visit again, tell them to call the Police.

oh dear, you are in a mess, I dont know anything about bailiffs, but you definitely need to call all your creditors and ask them for help. They may be able to freeze interest to help you slowly bring the balance down, or give you a payment holiday.

I hope it works out ok for you, I know how sould-destroying debt can be.

Maybe the citizens andvice bureau can advise you?

Bailiffs can only enter your house when accompanied by the police! Although, if your debt is registered to family addresses then they have every right to take belongings... what you need to do is change the addresses of the debt and then probably declare yourself bankrupt unfortunately!! Hope things turn out ok for you

No rights to go in to your home if your not there and if you are there they still got no right, you do not at to open the door to them you must get someone from your family to right to them and tell them your no longer there tell your family not to open the door if the come knocking, everyone thinks if they bring the police with them the must let them in not the case the police some times come to make shore there is no trubble have been down this road so i no what am talking about. try and get in tuch with who ever you owe money to and make a offer of some payment work out how much you have coming in and how much you have going out and make it more going out then you have coming in, i owe about 4000pounds and i pay mine at 2pounds a mouth and i work so do not worry your not a lone and there is help out there, NATIONAL DEBTLIN WEB SITE ITS ALL FREE and you will get your help there hope have help you mate.

As far as i know, they have no right. The onus is on them to prove the property is yours and not your parents. The fact they threatened your parents is just a loy to get the money in whatever way they can.

Tell your parents to seek advice via Citizens Advice where you should also seek advice re the debt owed, which should be paid back in some way.

No, they have no right to enter a property, not without a Court order, enforced by the presence of the police.

Where you no longer live there, then the rights of the door bashers vanish, as no one else, unless they agree to do so, is liable for your debts.

Your parents, or anyone else, if you are over 18, can tell the the door bashers to go f**k off, or even beat the sh** out of them as trespassers.

They've already told you the root of this problem. The onus, the responsibility, lies entirely with you.
I'm sorry you have had been unwell and hope you get better soon but you have let this go on for far too long.
Take advice and ask for support. Visit the Citizen's Advice Bureau. They won't pay your debts but they'll show you real ways to help yourself.
I got to a point where I thought I was going to be made homeless. It shook me up enough to realise that me and only me could do something about it - coz if I didn't, other people would and I probably wouldn't like what they would do.
That was a few years ago. Now I'm "in the black" (for the first time in my life!) and take control of things.
Feels a whole lot better than refusing to open post, sleepless nights and relentless feelings of guilt and worry.
And your parents, God Bless them, wouldn't have to share your worry and anxiety. They could relax and be proud of you.

When you take out any form of credit, your address that you give, is normally part of the security system, therefore, should you move, and to safeguard any family members from a disturbing and embarrassing visit by bailifs, you must inform your creditors of your new address, if you don't do this, they have the right in law of entering the only address on their records, but cannot walk out with property unless it can be proved it is yours, they can sequestrate the property, this means that a list is made of all items inside the property, and these items cannot be removed until proper ownership is proved. Under no circumstances should anyone, other than yourself, pay any monies, get your parents to phone the police prior to allowing the bailifs inside their home.
