So i got evicted from an apartment that I was living in with some people. I got evicted because of the other person not paying his half of the rent and not telling any one. so now i have debt collector calling me saying that we owe $3,000+. Now the guy told me that he was going to pay everything off, but i really don't want it to go on my credit if he screws up and doesn't pay. i talked to him about it but now he wont answer my phone calls, so what should I do to get him to hold up to what he said her would do?

I have receipts from everything that i have paid and my next step was to have him sign a notarized agreement that he will pay everything off, hes just not answering. I also have witnesses to him saying he would pay everything |

This is serious, and can ruin your credit ! Send him a CERTIFIED letter, demanding that he pays what he owes! Make sure you have ALL the paper-work; lease agreement, canceled checks, money order stubs, etc.. Take him to court, and sue him for what he owes ! You could also be awarded any late fees, and , or penalities incurred ! You MUST have all the paper-work !!! |

If your name is on the debt, then you have only 2 choices. You can either pay the debt off, or it can go on your credit report as a delinquent debt.
If you can prove that the other person is responsible for the debt, you could potentially sue them, but that won't have any affect on whether or not it ends up on your credit report. |

Depending on what your state's "limit collectable" in Small
Claims Court is.... you might want to check-out the chances
of your appearing on one of the "TV COURT" shows, like
JUDGE JUDY, etc. If your state's "limit collectable" is, at
least, the amount the person allegedly owes you.... it just
might SERVE YOUR PURPOSE. |

I was in this sort of situation a few years back and it's not fun. I would get in touch with the debt collector and see if they are trying to get money from just you or if the other person is legally responsible as well. Get the facts first, whether it's morally right or wrong. You need to know legally what you are obligated to do.
Secondly, I would try to call any friends or family that your former roommate has. E-mail as well. This can be documented at least. Even if you know where they are living, mail a letter and keep a copy. Let them know that they are required to pay their portion.
Good luck. It's a tough situation. I hope you are luckier than I was. I ended up having to pay it all myself because my roommate didn't have as much credit as I did and he never paid.

you can sue him in small claims court & get a judgement if you win. It is a he said she said so it might be difficult to win. Do you have any written evidence he agreed to pay ? Besides the lease.
If the witnesses will come to court that will certainly help. Unfortunately they will probably miss 1/2 days work.
You could first send him a letter saying you will sue. It might work if he has anything.
Being notarized only proves it is his name, not that it is binding. It doesn't make it official. |
