This is not 1980s, where you can file for bankruptcy and start over again. New laws have been added and more are being added so that banks and creditors will still get paid. Even if you file for bankruptcy, banks and creditors will still try to get assets from you to recoup their costs - i.e. house, furniture, appliances, savings, future earnings, cars, retirement, etc...

In other words, the banks/creditors will be paid with interest.

Most ppl who filed for bankruptcy wouldn't want to stay a "broke-@zz" forever. They will work a repayment plan over 15 years period to repay their debts or even longer. No one wants to leave this world leaving a tarnished name behind with their family members and loved ones.

So, if you maxed out your credit cards and intend to be debt free one day, you would still have to repay all your debts.

It could be looked on as fraud. The Judge could see it as a deliberate attempt to run up your debts and could Order to you repay the additional costs before you're released from bankruptcy.

hmmm, I'm not sure but as I recall, these items could be excluded from your bankruptcy filing and you'll still have to pay for them.

NOT to mention that everyone who knows you--and even people like me who don't know you--would think you're a real A$$ for doing it.

What do you think happens when people file bankrupcty? The businesses they owe money to write-off the bankruptcy from their business tax returns.

Guess what happens when a company writes off a loss. The government makes less money from them.

Guess who pays when the government makes less money from business taxes. TAXPAYERS pay!

For Christ sake, have some self-respect and some moral fiber and do the right thing.

As I recall, there is not suppose to be any activtity for 90 days before you file. Plus the fact the bankruptcy may not even be accepted by the courts.

i think that would be fraudulent, not to mention that if you do it intentionally, you are only making your situation much worse. unless it is a legitimate emergency that you can prove was pressing and dire, i would absolutely NOT do that. if you're in a situation where you are filing for bankrupcy, i would NOT mess around whatsoever with credit. it will only make things worse for you, and possibly turn into a criminal offense.

Most lawyers tell you to max out your cards. But laws are always changing and are different from state to state, so ask your bankrupcy lawyer before you do anything!
