Mike78705 | When my wife and I divorced this year I found I'm unable to pay on my credit card debt.? |
Once I pay the house, car, child support and household expenses there is not much left over. I've thought about filing bankruptcy but right now i'm doing nothing. What's the best course of action, do nothing and listen to the phone ring or file bankruptcy? |

Hi, by using services from a (good) debt relief organization you will stop receiving phone calls asking you for money. You will pay a fixed rate amount every month which will never go up. You won't be dealing with your creditors any more. The "debt relief people" will be paying your bills for you, and your credit card company is out.
You then pay the debt relief company.

Doing nothing will get you nothing. Filing bankruptcy in not a wise choice, with the new laws it harder and it does not solve your problems. I would downsize. Do you really need that new truck, big house, big screen TV , ect. Go to htt//p:www.daveramsey.com/. It will be worth it. He helps you get dept free. When we started we had 8 debts now we are down to 2. |

Welcome to the wonderful world of divorce. My husband was in your same situation when he divorced his first wife. He filed bankrupcy. It took care of everything. Granted, though, you will have a hard time getting credit for a few years after if you file. That, or you can just make the minimum pmt on your cards until you can come up with more money. |

Do not go through debt relief or consolidation companies. Here is some advice to do this on your own.
First thing of course would be to cut up the credit cards and make a commitment to never charge again. Then follow the following plan.
Make a list all your debts by amount you owe from smallest to largest. Then begin by paying the "most" amount you can each month to the smallest debt with the idea of paying it off quick. Then, only pay the minimum payment on the larger debts. Continue doing this every month until you have the smallest one paid off. Everytime you pay off a debt, call the company and tell them to close the account ... that you paid off the debt and that you do not want to leave the account open. They will try to talk you into leaving the account open. Don't do this as it is too convenient and you will be tempted and will sink into debt again. You then start paying the most you can on the next smallest debt in line and go on from there until you have each paid off. Every time you get any extra money, whether it be $5, $10 or more, apply it against your debt even if you have already sent in a payment. You can send in payments more than once a month. Don't go out to eat. It's "beans and rice, rice and beans" as Dave Ramsey always says which just means (cheap meals that you can fix at home). LOL Also do things to make money like garage sales, sell on eBay, get a second job, anything to help you get money to apply toward that debt. It's not about obtaining the best credit score, it's about eliminating the debt.
You can get more help on how to accomplish this by reading and listening to Dave Ramsey. He has a radio talk show which you can hear on line through his archives, live on line, or by radio by entering your zip code and find out what time of day his show airs. Plus there is a lot of reading material on his site to get you started. In addition, he has forums from his site to get help and advice from other people who are in debt. Dave has been there (with debt) and knows what it is like and is now helping people to get out of it. There are people that have followed this method with over $100,000 in debt and have gotten it paid off without going through bankruptcy and without getting some debt help company to do it for them. Dave's website link is below.
I hope this information helps you and you get the relief you need. Best of wishes to you.

Another thing you might be able to do is call a bank and work out a deal. |

I understand the fradstration of divorcing, and payment. What you can do is to see can you work something out from your equity of your house. It sounds like you are to the no-exit road.
Do not wait until your credit is ruinned, because if you credit is good now. Many lender will be able to help you, once your credit become worst. Then its a matter of time to file bankrupcy.
Good luck. |

Bankrupcy is definately a last resort.. that sticks with you and makes life hell. Try to work out a deal with the card company first and then try other consolidation options if that fails. DO NOT file bankrupcy unless you have absolutely no options left. |

I feel for you!!! In this world it's ALWAYS the men that get the SHAFT!!! The women get to keep the children REGARDLESS of how unfit they may be as mothers, the men only get HALF of what is rightfully theirs, and yet they have to pay for EVERYTHING!!! In court they ALWAYS turn deaf ears to men, and what they have to say (on top of laughing at them in court), and listen to the women's "horror stories" (I suspect even ENCOURAGE women to either lie or fabricate or exagerate such stories). I would say just file for bankruptcy, and if you by chance accumulate any further assets, put it in SOMEONE ELSE'S name. Hope this helps. Good luck!!! Sorry to hear about your situation. |

Call them and see if they will help make more reasonable payment arrangements.
Better yet go to your bank to ask about a consolidation loan.
Last but not least, go to credit counselling. They can usually assist. |
