Example Like all money in bank account, all stocks, all bonds, all material things to parents. All credit Debt, medical bills, house mortgage to ex-wife. Or do debts have to be paid before any assets are to be given out.

So when you know you are about to die, I guess it makes sense to sell everything you own, and give all the money to your family and friends. Then take out a big loan for $100,000 and give that away too, and die :P |

Debt can only be passed to anyone else that was listed on the account. Otherwise they are part of the estate and all the assets have to be sold to pay off the debts. |

No, the estate has to take care of any debts existing at that time and normally death voids contracts involving future payments although car and home loans may require selling the property to cover the loan. If there is not enough money to pay all the debts, THEN the process is terminated - heirs named in the will don't get anything, but can't be gone after for the debt. |

Before any assets can be passed to anybody all your debts need to be paid. So all your creditors will be after your assets before anybody can get them. Which means they will get nothing. How did you get $2,000,000 in debt? |

lorijotx nailed it. However many inherit the estates debt is paid first and they get whats left- minus the elected ones stake first of course |

In very simple terms, when you die all of your assets and all of your liabilities become part of your estate, except those designed by law to bypass probate. If you have a will the disposal of your assets and liabilities will fall upon the executor of of your will. Generally, the liabilities will be paid off with the assets in your estate and any remaining assets will be distributed in accordance with your wishes. If you die without a will an executor will be appointed by the court to handle the process. |

This sort of arrangement is void ab initio under the eye of law. No one can do anything like that .....this cannot be enforced by law of any country of the world. |
