If it was agreed when you work for a company that you would receive vacation pay, then they do owe you that money whether you quit or they fire you. If it's understood that you receive it, it belongs to you.

The only exception to this would be if you were in a probationary period (like the first 90 days of working at a company), or if they issued any kind of policy that says they do not have to pay it for a particular reason (like quitting suddenly). If they haven't paid it to you, call the payroll person or HR (human resources) person and demand to know why that money was not paid. They have to give you something in writing, and if the answer is not good enough, you have a lawsuit.

It really depends on company policy. You might want to check with your state's dept of labor to see if there are any state laws requiring payment of earned vacation time.

Most companies do pay for earned vacation but not necessarily sick days.

depends when you earned it. usually you earn it after 1 year and then must complete the next year to be entitled to another paid vacation and so on

As I understand it, it is up to the employers policy as to whether or not they are required to pay this out. However, verify this with the State Department of Labor for the State in which you reside before making a decision to leave your job or sue your former employer.

I'll assume this question pertains to the US...

There is no federal law requiring employers to pay employees for unused vacation time. Laws vary from state to state, but most states do not have a law requiring payment of unused vacation time.

If you have an employment contract, that may state whether you will be paid for unused vacation time. Also, your company may have a policy manual that states whether employees are paid for unused vacation time. Usually, a company will follow their stated policy.

I'm not sure but why take that chance, if you have vacation days take them before you quit. Like the last call in and use your vacation time.

Yes, all companies are required to pay out vacation time. You have earned it. It is yours to take so they owe you that time if you have quit already.
