10 years ago, I got married. The 100 shares that I had prior to marriage has increased in value. Do I have to share the earnings with spouse in divorce?

Did you sign a prenuptial agreement? If not, than I think you do have to share it.

Depends on your state and how good your lawyer is.

Once you marry, 1/2 is hers.

It the law unless you're in a commonwealth state (texas, florida, etc)

you share them based on today's value

I'd say you do. If you want half of what your spouse has you have to give half of what you have. That's only fair.

KathyS
I think that might depend on what state you live in. I know that where I live, anything you obtained prior to marriage is yours. You should ask an attorney.

Probably.....dunno what state/country you are in but if your justice system is as messed up as the UKs justice system is then more than likely they (your spouse) will get everything....

davidacapps
Get an attorney for this.. in most states you might. Unless a pre-nup was arranged prior to the marriage.

The Sailors and Soldiers act of 1969? 60 something applies to more than Sailors and Soldiers...if married more than 5 years without the pre-nup it's 50/50 on everything....so I have been told.

sharky
unless you had a pre nuptual agreement in 90% of countries yes.His earning power 10 years ago was probably higher than yours should he have shared that with you be fair you'll be entitled to half his worldly goods including insurance policies.

Are the stocks in your name only or joint? Does your spouse know of the stocks? If they are in you name only and you had them beforehand, Id say you are ok, but who knows, the damn lawyers will try to get everything.

If your spouse does not know about the stocks, sell them and put the cash in hiding (out of a bank) until divorce is final.

Ask a lawyer or attorney... duh.

If you are asking just for the general opinion, I believe that the stock had nothing to do with the marriage and all the increase should be yours. But technically when you marry unless you had a prenupt signed half should go to spouse. But my opinion still lies with my opening statement. Its like Toni Morrisons ex-husband trying to sue her for money in the divorce, when she was loaded before she even met him. He doesn't deserve to get half of everything that she earned after the marriage.
