First of all, is there a will or legal instrument saying who is the executor or person who will take charge of and make the decisions of the deceased?

Second if there are any estate items: cash, bank accounts, retirement accounts, insurance proceeds, real estate, cars or things of value?

Thirdly, if the decedent had bills to pay, the person in charge of the estate will need to pay these off. But if the person dies in testate (that means broke) and has bills, the family does not need to pay--sorry creditors. But the mortuary will do nothing until they get paid, so you may in this instance need to pass the hat.

Whoever is in charge of the deceased person's estate is legally responsible for paying the bills out of the money in the estate.

Nobody is personally responsible for paying those bills out of their own pocket, unless they are a co-signer on the account. If the deceased leaves more debts than assets, then the remaining debts die with them.

The person's estate will be liquidated. If there is 401 k, insurance policies, personal property, and real estate they will be used to settle any debts left behind. That is why there is a executor appointed by a court to take care of this. If there are any credit cards that are joint, the person whose name is on the cards will be left to settle the credit card debts. If there is anything left after paying those debts, what is left will be distributed accordingly.

The assets the person had could be seized or taken off the value (such as a house). Next of kin is sort of a wives-tale.

Depends if they have a estate. If your broke relative dies penniless and you're considered the next of kin you don't have to pay a dime. Some bills don't have to be paid when someone dies (student loans). Some people pay a dollar or two on their credit card so the balance is paid off when the credit card user passes. If there is an estate then the next of kin may have to pay from that estate (won't have to pay out of pocket but may lose part of what was to go to him/her and other heirs). Sometimes there's a stipulation that creditors must contact a lawyer in charge of the estate within a certain amount of time to collect the debt.
