A breach of this agreement will result in my taking legal action against you.

No. Don't sign anything until you have your $982.08 in your hands, in cash.

After you have your money, what's the point of signing anything. I'd tear it up and throw it out.

If anything, she needs to be signing a legal promissory note to you. If course, you should have had he do that before you gave her the money, but that's water under the bridge at this point.

Okay...if you're worried you cannot collect if you sign it, not true. Tell her you will sign it on the 20th after her check clears.

Just a note...if your are contacting her too much, give her some space. Owing someone money doesn't give that someone the right to be a stalker. Expect the money on the 20th. If she doesn't pay you, take her to small claims.

Ask if there's any other agreement she'd could come to, and it would be better to get it verified by a bank or something. Not verified, but it's where the bank would see you both sign it and that way, she can't hold it against you.

As for the threat, it seems kinda empty. How far away do y'all live to each other, or?

Not only would I not sign it, I would keep it to show in a court of law, if necessary, that she acknowledges that she owes you money. If you give it back to her, you may be giving away the only real proof that she owes you.

Give her untill the 20th to make her payment. If she does not make it by then, then contact her on the 21st and tell her to cough it up or YOU will be the one taking legal action.

She is not promising to send a check until the 20th and you
forfeit your right to contact her about the debt as early as the

What are you going to do if she doesn't send a check on the 20th?
Since you promised not to contact her since the 8th?

What is really funny about this letter is the following:
She acknowledges that she owes you the money...
therefore you have the right to contact her and demand repayment.

Only when she has paid you back in full can she demand that you leave her alone.

I would love to know what kind of legal actions she wants to pursue?
Any judge would laugh his fanny off. It is not considered harrassment when a lender contacts a borrower and demands repayment.

Ask her to sign the following instead.

I, (put in girlfiends full name, first and last) acknowledge that I
owe to (your full name) the amount of $1000.
I will pay this debt in full on October 20th, 2008 and am aware
that if I don't pay on time that this matter will cause legal actions
and that I will be responsible for any attorney fees and court costs
if this has to be settled in a court of law.


Signed and dated by both of you.


(That ought to scare the ..... out of her).

No - No - No You have nothing to gain by signing this letter-and it could cause you big problems. If anything came up in the future she could point to this letter and say "you signed that all matters were resolved." I would send her a very business-like letter, not mentioning her letter, reminding her of the total amount due and that you would like it paid as soon as possible. She sounds like the type who may be recording calls, so be careful. If she is so concerned about getting things in writing, she can use your letter to confirm the amount of the loan.

well, its in writing that she will pay you back for the amount, and so you could take it to a lawyer if she doesn't and use it against her.
but how does she expect you to sign it if you cant contact her after today?

It depends....are you ok with the agreement? Because legally, if she writes that, you sign it and send it back to her and then don't contact her until she gives you the funds then you will be in a better position to take her to small claims if she breaches this.

First of all, its spelled Cheque.
And switch the bottom to, once the cheque is received, blahblah 2008. You will not contact her ever.

Once you've got the money she owes, then what is even the point of the contract?

Add: Dont forget to make sure you BOTH sign, TWO copies. If you want it to have any legality.

Yes I would. The monetary difference is only $18.00 and you spend far more for legal fees and court costs to pursue that additional $18.00. But my sense is that it is the other stuff that is bothering you.

Your ex-wife wants no contact with you for whatever reason and that is her right. You need to recognize that and start a new chapter for yourself without her in it.
