My father had a basic outpatient surgery, complications followed, with a heart attack, then stroke and then life support, this left dad hospitalized for 8 months. Because he lived out of state he had a close friend of the family help him write his bills as she did for years, dad suffered from horrible arthritis and writing was not legible.. He rec'd soc. sec checks while in the hospital, the lady signed his checks as usual and deposited them in to the account, 8 months worth, dad dies, without a living will, who gets the money? |

According to the law, she gets nothing. Zero. However, you may want to give her something.
Without a will, assets go to the remaining survivors: first to the surviving spouse, then to children. You will need a probate attorney to help with this situation. |

You mean no will, not living will - a living will is a document regarding medical treatment and has nothing to do with distribution of assets.
The estate will pay any bills he had. If there's anything left over, state law will say who gets it if there's no will and you're in the US. |
