Our apartment was recently damaged by a massive hail storm, and as luck would have it, our dishwasher went out 2 days later. Our landlord told us our roof would be fixed after broken windows were repaired, and the dishwasher is something they would get to "eventually". It's now been 2 weeks since the thing broke! Obviously, my water and gas use has increased since I'm washing the dishes by hand.
Since my lease states the dishwasher is included in the apartment, and the apartment is responsible for all repairs, am I within my rights to get a partial rent reduction? I anticipate the landlord will put up a big fuss about this, but I don't think it's fair to pay full price for the apartment when I can't use all the amenities. |

The landlord is required to repair or replace the dishwasher within a reasonable amount of time AFTER you have made the repair request in writing.
Since not having a dishwasher is an inconvenience and not a habitability issue, the landlord is not required to repair or replace immediately. The landlord has a reasonable amount of time, which could be up to 30 days in some states.
A dishwasher is not a necessity, so any rent reduction for not having a dishwasher would be minimal at best and would have to be determined by a judge. |

You can't determine on your own if the lease is broken, just like a landlord can't, even if you do not pay rent, they have to take it to court. 30 days after you send in a written demand for repair you can file a breach of contract case. If the judge agrees with you all of your rent would be paid into an escrow account until the landlord makes the repair. |

Get three written estimates to fix it. Write a certified letter to the landlord that you will withhold the amount of the middle estimate on your next rent payment to have it fixed. You should make sure that you give the landlord 15 or 30 days to respond before you actually fix it.
You'll have to pay for it out of pocket, but this will most likely hold up in court. Make sure your prior experiences concerning the dishwasher are documented. Write out the timeline (broke: 1/1/10; called for repair 1/2/10, 1/5/10, and 1/10/10, etc) and pay $4 to have it notarized. put it, and the written estimates, someplace safe just in case you need them.
A good way to get in trouble is just to withhold some made up amount from your rent. You would have to at least pay it into escrow, but even that can be dicey. |
