I have a 6 month tenancy agreement (shorthold) between me and my tenant. He has been in the flat for five years and only ever signed the agreement once when he went into the flat. Should I have asked him to re sign each six month period or does it just still stand and roll over for the next six months. Or, because he has not signed every six months does this make him a sitting tenant? |

In the U.S. it makes him a month to month tenant with 30 day leasehold estate privileges. |

At the end of a Shorthold Tenancy agreement, since you didn't re-new that agreement, your Tenant is now a periodic tenant. i.e. holding over on the original terms of that tenancy and you are renewing it monthly when you accept rent from him/her. If either party wishes to terminate that greement then notice is required to do so. In the case of your tenant, he should give you 1 month's notice to terminate. In your case, though, for you to terminate the tenancy - you MUST give 2 MONTHS notice.
If your Tenant paid a deposit to secure the tenancy at the beginning of the tenancy, then you should return that deposit to him/her on vacation of the accomodation. |

Me and my partner had a 6 month tenancy agreement with my old landlord
We were there nearly 1 year and we only signed it once, when we rang up to see what would happen, he said well no need to sign another one, you can stay in the house and just give me 4 weeks notice if you want to move out
we moved out 10 weeks ago - and gave him 4 weeks notice ,the day 4 weeks was up we moved! :-) |

A lease is good for a certain time period, when the time is up the lease is gone. After the original lease expires a new lease is not mandatory, and most places do not require them. But the basic rules of the landlord tenant act still apply, such as moving notices etc.

After the lease expires, the tenant is technically a tenant at will, with the lease being extended month to month according to the original terms. A new lease is not necessary, even if the rent or other terms are changed, although any significant change of terms ought to be memorialized in a new lease. Either side can terminate the tenancy with a 30-day notice. |

Get him to sign a new agreement every six months, to cover yourself in any eventuality. If you want him out just give him a couple of months notice. |

No all tenancy agreements in the UK are always for an initial 6 months unless otherwise stated,IE "only 4 months".
After the initial 6 months all rentals are month by month,which means that either party only have to give(by law) 1 months notice to vacate the premisis.This should be written into the tenancy agreement but if it is not you are still only on the monthly notice to quit...
