my landlord agreed for me and my room mate to each pay 550 a month. I signed a lease and they were going to give me a copy once my room mate signed it and they never did. We repeatedly asked and it kept getting pushed further back. After 7 months i sent them a letter with my check requesting the lease before next months payment. At a sit down with the lease they presented me a completely new one. asking for 750 each from us. I dont have a lease put i have check stubs that say for rent in the amount of 550! What should i do?

Don't sign the new lease. Continue to pay rent as agreed. If he sues you, he will have to produce a written copy of the lease that you signed. You have a few options. Write a letter stating that you do not agree to the new terms and that you want a copy of the signed lease. Include it with your rent check (and make note of the fact the rent check is included with the letter). That way you have proof if he sues that you tried to get a copy. How long was the original lease for? Probably a year. If I were you I would look for a new place to move at the end of your year. Good luck, bad landlords suck. |

I'd give them a 30 notice to move out .. the new lease that was given and altered does not have your signature on it. At least it better not. There is nothing he can do to take you to court on but save everything you give him and he gives you. He does not seem to be trust worthy. I wouldn't give him another dime. Good Luck ... You might want to look into the BBB on this one as well and from them try to get copies of what is found for further reference of this crook. That way when or if it goes to court..... You would surely win and the jugde may fine him for his actions. |

call tenants rights, but first ask for a meeting, tell them that the lease had said 550, not 750, tell them you want a copy of the lease or you will be calling tenent services. If by any chance your first lease was for only 6 months, than after 7 months its kind of moot point. next time you move, ask for a copy of the lease before you hand over your first payment, or at least a copy of the page that says what the monthly payment is, i also recomend keeping a copy of the move in inspection. or make a video. how long was first lease for? |

well ur screwed bc u allowed this much time to go by without getting a copy of the original agreement. i would tell them if they cant revert to the orignal terms of the agreement than you are submitting ur 30 days notice and u will live next month off ur security. (bc chances are if their screwing u with a shady lease their going to screw u with the deposit as well) i suggest cutting ur losses and move out their shady people. unless u can afford an attorney this situation is going to get messier. |

Don't pay rent until they give you a copy. Make sure you keep a copy of your request for the copy of the lease. Do it again with a certified mail. Document everything. You got a good case if you can prove it. |

If you refuse to sign the new contract, they would have to furnish the original contract that you and your roommate signed. They have the option to raise the rent on a yearly basis, but it is unfounded to raise it that much more than what was originally agreed to. It would only be after the year contract (if that's what it was) before the adjustment can be made- and they would have to furnish the changes to you in a timely manner, which in most states is at least greater than the 30 days you would have to give for your termination/release from contract. Continue making the payments you have for the past 7 months on time, as you would not want to give them any reason to take action against you in court for eviction. I would write a letter along with the check which states something along the line as "As per our lease contract." It's going to be pretty difficult to explain why there has been a deficit to your monthly checks if the landlord pursues this further. There is a governmental agency for Tenants Rights that can become involved as well. |

They have a right to change terms, however this right must be outlined on the previous lease and since they never provided one you definitely have a gripe. I think it best that you look for another place and just move as it sounds like the Landlord will always be untrustworthy. If the landlord gives you grief for breaking the original just spend $100 and get a lawyer to draw up a letter threatening a lawsuit. Just remember, if the landlord is a big management company they might call your bluff and probably would steamroll you in court. You should have made a special trip to the LL's office long ago and demanded a copy of the lease. I think now you can see why as it comes down to your word against theirs. |

If the original lease required your room-mate to cosign...and they didn't, it sounds like you have NO LEASE. After so much time, for the rent to go up, I think you might be screwed. Perhaps you should ask why your room mate never cosigned. Sounds like they were the ones that have messed up this deal. There is one thing you can do though - you can always MOVE, if the new lease is not acceptable to you. Without an effective current lease, the landlord might be able to evict you - although I'm guesing it depends where you live. |
