A Messy Situation in Real Estate?
My father is getting ready to begin a huge home improvement project(i.e. renovation and restoration). However he has a huge problem. When my grandmother passed back in 1984, she left the house and property to my father and his other 5 siblings. The problem is, 4 of the siblings have been dead for 25 years. When they were, they never paid property taxes, utility bills, or contributed to anything with the household, my father has been the main person who occupies the house, maintains the utilities, AND pays the property taxes. My father is in the beginning stages of the project but cannot seem to finance the project. In order to obtain a home equity line of credit, he is told that the remaining parties on the deed that are deceased would have to be removed from the deed. My question is, the children of the decease? They are trying to get house out of my fathers name so they can sell the estate and get the money. if my father gets the line of credit does he owe them anything?

Your father should hire a Real Estate attorney NOW! The best way to find out how to proceed is to determine how ownership of the property was taken by your father and his siblings. If the property was taken as ownership with right of survivors, then upon the death of each family member, the surviving sibling split the dead ones ownership among them. If your father is the only one still alive, he would own the property in total.

You will need an attorney to perform a title search to ascertain how the property was divided, unless you have a copy of the deed and a copy of your grandmothers' will. Have him get an attorney NOW!!!!

Your father owns 1/6 of this house. If he wants to own it all, he has to buy out the other 5/6 of the house.

The heirs of the deceased parties own the other 5/6.

You need a lawyer, to see if there's some way under state law that he can bill them for all the back property taxes. If not, well, it's been his cost.

Utilities are FULLY his responsiblity, as he's the tenant.

He's NUTS if he does a big home improvement project before he has 100% of the title in his name. Which means, that money is likely going to have to go buy out those kids.

I went through damn near the EXACT same thing with my "relatives" in 2005. My grandparents REALLY tried to be fair to all their children and their heirs. But when they died, no one appreciated their efforts except me, the attorney and the Man who purchased the properties from my "relatives".

Whether or not your father owns the home out right depends on the wording of the will. Look for the words "Joint Tenants" OR "Share and Share Alike"....the last one is a doozey!!!!
You DO NOT want to see the last one on the will!

Wikepedia both terms for better explanations. Also, you have to check with the probate courts in your state because if ANYONE such as a sibling or spouse or sibling's spouse died in testate (without a will) you will have to start probate proceedings for the deceased. The property assessment can be done by the probate court also. VERY NECESSARY for the property to be assessed by the probate court.

your father need s to sell and get out b4 he has a heart attack from the stress coming his way.
he needs a quality real estate attorney and tax attorney.
the kids have an interest in the house.
your dad can recover the taxes and expense of the house from the sale.
do not put a dime in this house , until he buys it completly.

When your aunts & uncles passed, their share of the property was part of their estate and passed to their heirs. So your father will need to buy them out.

He should retain an attorney immediately. If the other 5/6 of the owners want to sell, they can sue your dad to force a sale.

You really need to consult with an attorney on this one. It is far too complex for any of us to even begin to know your options.

The other families could very well have a legal right, if a will was left by the parties and they stipulated that all assets owned by deceased were to be distributed to existing family.

I think the house belongs to Your father AND your cousins. However, I don't see how your father would owe them anything from a loan he has to repay.??????
I don't know where you are, but in some places there are 'squatters rights' meaning that a person living in and maintaining a house has certain rights. The best bet is to consult with an attorney.

The property belongs to your father and whomever his siblings left their inheritance to. His siblings' children should have been paying property taxes along with him. He should sue them for back taxes, utilities, and maintenance costs.

Sorry, but whoever his siblings left their piece of the property to owns part of this house. Your father made a mistake in thinking it belonged solely to him. He will have to work out a deal and probably buy them out of their shares of the property, but he SHOULD collect back property tax and other expenses from them.
