A tenant/friend has left my house trashed... what can I do?
I opened my home up to a friend that needed a place to stay for 6 months. This raised my rent not to mention was a hassle for my family and I. Last Sunday she moved out unexpectedly and left us with a trashed first floor. Dog hair everywhere, a fridge full of rotting food, trash everywhere, and some of her belongings. It is disgusting.

Now she has disconnected her phone, moved out of town, quit her job, and is refusing to take care of those things and pay her rent for the month. She is acting like a child, not like a 26 year old "professional" woman.

We did not make her sign a lease as she was a friend and it was short term. I know now that this was a huge mistake.

I have figured out the address of the place she is staying. What can I do to make her come take care of her responsibilities... or at least pay is the hundreds she owes us? Any suggestions? Or are our hands tied because we don't have a lease (which I know is what she thinks)?

Your friend has a lease, whether or not she realizes it. In the absence of a written lease, such rental agreements fall under a 'statutory lease' agreement, the terms of which are governed by your state and/or local statutes.

You can take her to small claims court for unpaid rents, cost of suit, cleaning of the premises, and disposal and/or storage of her remaining possessions. Tally up all your costs and unpaid rents, and get down to small claims court. They will assist you in filing your suit. Once she gets notice of this suit, she might think twice.

Simple solution . Take Pictures of all of the damage etc ..... Then go to Small Claims Court and sue her for the Rent owed as well as all of the damages , including hauling of her trash that she left .... YOU Will win !!

Small claims baby.Or if you would like to take her on one of those shows on tv,they will pay to fly you out there!! GL you should address this asap!!Oh make sure you have plenty of evidence,photos,videos etc.

First lesson: Never rent to friends, family or family friends.

You cannot make her come and take care of the mess. Clean it up and charge her whatever it costs you. Take pictures first.

You can sue her in Small Claims court for the rent owed and damages, she was a month to month tenant by default.

Send a demand letter for all amounts owed to be paid in full in ten days or you will sue her. Send it certified, return receipt requested. If she does not pay up in 10 days, file in Small Claims court.

The cost to file in minimal and if she loses the case, the court costs get tacked on to the judgment against her.

Can you prove she paid you in previous months? If so, you had a lease. If you took cash, that is harder to prove. See if you have a landlord/tenants court in your state. Take picture of the damages and dirt, and keep track of what it cost you to rectify the condition she left your property in. If there is no landlord/tenants court, look to file suit in small claims court.Good luck. I think you learned your lesson that agreements need to be in writing. IIt doesn't sound like it is worth hiring a lawyer for this one. The lawyer's fees will be higher than the amount in dispute, probably.

I would take pics and then get an estimate for someone to come clean it out or you can make up a reasonable price and then sue or just let it go and dont make this mistake again.

You have two options:

1. Take her to small claims court to try to recoup your losses and force her to clean up her mess.

2. Clean up the mess she left, accept your financial losses and treat it as a life lesson: business and friendship only works when you forget the friendship and treat it as a business matter.

Had you required her to sign a lease, you would have covered yourself, to a degree. Also, it would have made it clear to her that she has a level of responsibility in moving in with you and that you expect her to honor you and the lease. If she refused or objected to the lease, you would have been fore warned that she wasn't really your friend.

I know you felt awkward about asking her to sign a lease, because she was a "friend". But tell me, if she was really a friend, "why" would she move in without insisting on having one?

your friend was technically a month to month lease. now, you would have to prove that she actually lived there. did you get her rent with a check? did she have mail delivered there? i would talk to her about it. take pictures of the damage to the first floor. then, i would send her certified mail. lastly, you might have to take her to small claims court. this might or might not be worth it, depending on the damage/lost rent amount. next time 1. don't mix business and friendship 2. get a lease from her.

I'm sorry to say there probably isn't much you can do. The only thing I can think of is taking her to a civil suit, something like a people's court kind of thing. Take pictures of the mess, and come up with any kind of documentation that can link her to the place (ie bills, phone calls, mail, etc). Make a laundry list of things against her, hopefully the judge will lean your way and you can get at least the rent money.

Unfortunately as you didn't have a lease there isn't alot you can do. There is nothing worse than being betrayed by a friend!!

However, there is a place called the Small Claims Tribunal and they deal with general disputes about goods and services, Dealing with both consumers and traders with a claim limit is $25,000.

IT really all depends on what state your home is in. But basically you are screwed. I recommend cleaning your property and re-renting it as quick as possible that way you dont find yourself in any financial hardships. When you see your (friend) again submit her with the bill and just hope that she will MAN-UP and pay her part. If not, except the loss as a learning point and move on.

you could try to bring the police in. i know thats a little extreme but she disconnected you. even though theres a chance that they cant do anything bc she technically didnt break the law, bring people to back you up like ur family
