About to get evicted with 5 month old baby.....?
My and my fiancee are going through a hard time, our car was repossessed, he lost his job, and i have yet to find work since having a baby girl 5 months ago. we are 2 months behind on our rent and just received the eviction papers a week ago. i mailed off a letter to the plaintiff attorney stating the reasons why i think we shouldn't be forced to move but i have a feeling it doesn't really matter and that i will be receiving a 24 hr notice any day now. is there any way to slow down the eviction process and buy some time. and any advice to me about where we are supposed to go...we live in broward county florida and i contacted EVERY rental assistance agencies churches and all and no one has funds. even the homeless shelters have waiting lists. what am i supposed to do?? please someone offer me some kind of advice. and no mean answers please. do unto others as you would have them do unto you.

Your landlord has no obligation to support you. You need to rework how you look at things or your whole life will be like this.

You need to support yourself, do not be looking to take advantage of other people.

Your choice not to work, as well as the babys fathers choice not to work are not valid excuses. You will never qualify for low income housing now that you have been evicted.

People like you, with no car to live in usually end up living in one of the neighborhood parks. If you do not want you child living in a tent or box in the park, but are determined not to work yourself you might want to think about turning your baby over to social services, they will put the baby into a foster home until you decide to get yourself a job.

Try to get ANY job you can, both you and your fiance. If he works nights and you have to work days to make it and not have to have daycare expenses, that may be the way you have to make it for now. Temp agencies sometimes have jobs when others don't. Start looking for the cheapest place, even if its a studio apartment. Cut all expenses you can. If you have anything of value to sell, do so. Try to get on WIC and food-stamps for the baby. Good luck.

Do you have any friends or relatives at all that you could stay with? Don't worry about inconveniencing anyone, as long as you would be willing to take them in temporarily if the situations were reversed, then they would feel the same about you. You or your fiance needs to get a job immediately. Fast food, waiting, manual labor, mowing lawns, painting houses, ANYTHING. Take whatever you can get for now and once you are in a more secure situation you can look for something better. Good luck!

This may not be what you want to hear, but it is the facts.

Your rent is 2 months behind. The landlord had the legal right to serve you a notice to pay or quit last month and begin the eviction process then, but did not. He already allowed you another month to try to come up with the rent. Most landlrd's would not have allowed you to go another month without paying.

Your landlord is not running a charity, he is running a business. If your fiancee worked for a week and his boss refused to pay him, would he not take action to get the money that is rightfully his? Of course he would.

There is no legal defense to a non-payment of rent case unless there were previously reported and recorded habitability issues with the property. No answer you give to the court will change the fact that you did not pay rent for 2 months and still cannot pay rent.

The courts do not hold off ordering evictions because there are infants or children in the home. The only way to slow down the eviction process is to pay all of the rent due, which you cannot.

No judge is going to order the landlord to allow you to stay if you cannot pay the rent owed.

You are going to have to vacate. There is no 30 days, you have days to weeks before being physically set out.

You are going to have to turn to friends or family.

Thats so terrible, you should talk to your parents to stay with them for a while, and If your short on money I dont think you should be paying for internet connection if you can afford the rent, go stay it a friends house, anyone with a heart can't refuse your story.

The landlords notice only states his intent to take you to court to have you evicted if you don't pay the rent or move. He can't lock you out until a judge says it's OK to do so. You will have a chance to argue your case before a judge prior to being evicted. Landlords can't just walk in and kick you to the curb any time they feel like it. He'll have to win in court first. Which means he'll have to schedule a court date, wait for it to arrive, present evidence, hear your testimony, then abide by the judges decision. A 24 hour notice to quit will only be issued after all this has taken place. He eventually will win, but not before he goes through the entire process. And the baby might mitigate the outcome. Unless you leave first or pay up on the rent.

Only a judge can evict you. So make sure to show up at every court date, and respond to every legal notice in writing, on time. If you don't the judge will decide for the landlord by default. In my state (MA) it can take up to six months for everything to play out.

Find out if you have a Legal Aid in your district, you can call, but I would go there in person too. I am a paralegal and I worked as an intern for Legal Aid of Western Ohio and they work for free. Don't you have any local emergency social service agencies? Apply for Financial Assistance, Food Stamps, whatever you can qualify for. Ask your caseworker for agencies. Contact a local TV station. Check with local churches. Ask your family.

I've been where you are 20 years ago. Don't let pride or other people's opinions keep you from doing what is best for your child. Hang in there, when you can, go back to college, get a degree and someday you can repay the taxpayers for their help. That's what taxes are for, helping our neighbors-not making war on the other side of the world. And for God sakes don't vote republican. I hope you find some help.

You really have to plan for these things. I would possibly have started proceedings after the first day passed that you didn't pay, since as the previous guy showed how long it could take if I don't move quickly.

I have my own family to support and feed and a huge mortgage on that building my tenants live in as well as my own house. I have insurance and taxes and I have a lot maintenance on that building. And I have the occasional vacancies I have to cover.

Boyfriend better get out and pound the bricks from dawn until dusk looking for work. It's out there.

If I mess up and fall behind the bank will foreclose on me and ALL my tenants will be evicted. So people who cannot pay must make way for those that do.

It is hard to get assistance because of the economy. Everyone is hurting, and so charitable donations are way down. That being said, you can still get assistance from your state's welfare department. I don't know what it's called down there, but go to them. You don't have to make an appointment. Make sure you bring your eviction notice and all other paperwork related to it with you. They won't help you without proof that you are being evicted. They will make arrangements for emergency, temporary housing for you and your baby. In the meantime, your fiance is going to have to swallow his pride and work wherever he can and walk there if he has to. Even high-paid businesspeople are losing their jobs, and they are working wherever they can to bring in money. You do what you have to do, and you tell him to do the same.

Your parnter needs to stand up, be a man and find another job. He needs to earn money so that he can support you and your baby. Your baby is too little for you to be going back to work, and childcare will cost too much. Stay at home with the baby.
How did you get so far behind in rent? To be honest they have the right to evict you. Call the real estate agents and see if there is anything you can do to pay off what you owe.
Can you move in with someone for a little while? Parents? Friends?

I believe that you have roughly about 30 days before the next step is taken. I would advise either registering with all of the local temp agencies to see what they have for both you and your husband. One of you can work overnight and one during the day to cut costs of having to pay for daycare. Your fiancee can also try a security job with companies such as Whelan security, Gettier or Allied Barton security. you only need a h.s diploma, go through two days of training (paid) and there is no physical labor just monitoring screens for corporate and local businesses. You both actually could do it and they can have you start working within a week if you stay on top of getting a short interview set up, getting your license (no test, just go to local police station) and complete training. good luck.
