Accept a check for first, last and security deposit?
I am renting my grandmothers house, never been a landlord before. I am due to sign a lease tomorrow (prorated for the month) and collect the first and last month rent, and security deposit. What happens if for whatever reason the check given to me is no good? By the time I will know, they will have already signed the aggrement and moved in.

When I've signed leases, they didn't accept checks. Just money orders or cash.

If the check bounces, kick them out.

In some states.....you are not allowed to collect "last month's rent".....

Make sure your lease specificies that rent is due on the FIRST CALENDAR day of each month.....and must be received by 3pm....that way you are not pacing the flloor at 8pm wondering if they are going to pay.....

Meet for the lease signing AT THEIR BANK.....

Make sure you know your state's laws regarding landlord/tenant issues....

For first time checks, go to the bank that issued them and ask if there is sufficient funds to cash the checks. If there is, then cash them and deposit it into your account. You can also call the bank from your cell phone if you need to know right away before leaving the apt for them to move into. Do not sign the lease until the bank has cleared the checks. Tell them you need to make a copy and they will have nothing signed that gives them the right to move in.

You can also ask them to stop by an ATM to get a printout of their balance.

There should be a clause in the lease about NSF or bounced checks - they would pay a fee of $25-50 and have to give you a money order within 5 days for the entire amount - or that in such a case the tenancy is void - that is just an example of the possible terms.

Tell them you will sign the lease agreement ONLY when their check clears. You should also include this in your lease agreement.

If you don't and they move in and their check bounces, you'll have to evict them, which is a hassel. The law is mostly on the side of the renter than the the owners'.

You should do a credit check on them before allowing them to sign a lease. If the credit check is good, then it is unlikely that you will get a bad check, and if you do, it will likely be taken care of quickly. Other than that, this is part of the risk you take when you become a landlord. You will at some point in your landlord life, receive bad checks. You should give the tenant a chance to make it right and if they don't, learn about the eviction process.

My general rule is to accept cash if move in is less than 2 weeks away. If we are more than 2 weeks out from the tenant moving in I will accept a personal check.

At time where it is less than 2 weeks I will accept cash or a bank cashier's check only. If they don't provide either of these then they don't get the keys.

The last thing you want is someone living in the property that you have no money from and then need to evict. An eviction can take 60 dys or more depending on your area and how well he tenant knows the tenant laws.

if the check bounces not only will you have no money from them, you will have no rent for 2 months plus you will have to pay out of pocket to get them evicted which will cost a couple hundred bucks. Then if they damage the property you will need to repair it to be able to rent it out again.

trust me, no $ no keys.

Hopefully you have done a full background, credit and eviction check to make sure that you know who you are renting to. Picking the right tenant to move in is the BEST way to ensure you stay a landlord and protect your property.

Doesn't matter. They have to pay you. That's the agreement. If the check bounces they didn't pay you and broke the contract. You can be a nice guy and give them time to pay it back plus whatever fees you received from the bounced check. If they don't pay in the time frame you gave them to pay you back, then you can go to the courts and start the process for an eviction.
If they do pay you back, you can request from them to give their rent payment in the form of a cashier's check, money order, or cash. Be sure to keep records and give receipts for payments received. i would even take pictures of the house before they move in, just in case you ever have problems with the tenants. This way also when they move out you can assess any damage they may have caused to the property.
