COCHYN | Advice please from landlords? |
I have been renting a property out for 4 months. I reluctantly went to a letting agent to find a tenant after being messed around a lot. A family on benefits with 3 children (1 on the way) is renting the house. They have been a bit unreasonable about giving us access to fix things etc. My partner and I called in recently to find the place in a right mess (They knew we were calling) She was smoking (supposed to be let non smoking), there was stains on the carpet and the smell was awful. I am not just talking about clutter here, but a dirty house. I left it spotless. My partner and I rent ourselves and we leave wherever we rent spotless when we leave. I struggled to get this property, and decided to get a rental property before buying my own home. I am worried that these people have no respect for my property and am thinking on the next inspection of telling them they are out. I am too nice, but everyone says they should be thrown out. Any advice please? |

Check the rental agreement carefully. Then follow the terms for ending the contract very carefully. Don't leave these people in a day longer than you have to, to do that is just storing up trouble. Check on the contract agreement re withholding their security deposit but normally people like this leave in arrears anyway.
Long term renting is a question of mutual respect between tenant and landlord. Clearly they don't feel they owe you any respect.
This is a case of protecting your children's inheritance. Get rid. |

This is actually pretty mild for section 8 tenants. You will be lucky if they do not destroy the place.
You did not say which state you are in. In most states you will not be able to evict because they are pigs. I am sorry to say this, but they have the right to their discusting habits and standard of living.
If you have a clause in your lease about smoking you will have saved yourself, you cna evict on that. But, only if it is in writing.
BTW, they do not "give you access" to your property! You give them 24 hours notice and go in on your own schedule! Do not let them push you around.
You might want to take a video tape and/or pictures. This could get very ugly. |

Its pretty hard to have a "spotless" house with kids, but I guess you wouldn't understand that.
Your attitude is why I no longer and never will again rent from a pirvate landlord. You people charge £600+ per month for a house and then disrespect tenants' privacy, kick up a fuss if the house isn't like a showhome, its ridiculous. That is their home. You are profitting greatly from their tenancy as you are being paid for it. |

Hold them to the terms of your tenancy agreement. Read it through and mark any points which are relevant to this particualr case. If you only had the rental agency find the tenant for a fee, then you will have to deal with this yourself. If, however, you pay them a percentage of the rental for management of the property, then approach them and tell them in no uncertain terms that the situation is unacceptable and they must act on your behalf and quickly. You cant just throw them out, unfortunately. Again, its down to whats written in the tenancy. Make sure that whatever you act upon, you do everything in writing in case you end up having to take the matter further. You will probably find that lots of tenants have no respect for your property (not always!) and a good tenant is like a needle in a haystack. |

i would advise them of an inspection ,with a warning that if anything is sub standard they will get notice to quit,but it also depends on their contract, we gave 2x 6 monthly contracts and the tenent is fine,so we upgraded to an open contract with 3 months notice fron either party,all rules and regulations should be stipulated in your contract with them, if they are in breach of this throw them out. |

I have the same problem with being to nice. You do not have to have a reason to evict so if you want them out, just give the 30 day notice so you can get in there and get things back in order before ay more damage is done. |

I, too, am known as a "nice landlord" but I can not stand filth. I would tell them that you are giving them until the next inspection to get the place in proper order or you will be evicting them. You can't be a push-over or you will constantly be taken advantage of. We ended up evicting one of our tenants and if we hadn't our investment would have been at the risk of being condemned. So, when we had to be nasty, we decided that was the way to be. |

First of all always let the agent manage the property...seriously this should be his headache and not yours. Many times pple feel the 10% management fee is expensive but its worth it in these cases...don't you think...?
You can never enforce a no smoking or no pets policy in the real world...seriously...
You have to give them notice really you can't force pple to clean up...if that is the way they are...also where is their deposit...? the agent (assuming you have placed it in the deposit scheme as legally required from April) you should deduct whatever it costs to put it right...from your description of the property the deposit will not cover the damage...
so you could chase them through small claims..not sure you will have much luck you'll have with that...you will probably be one of many pple persuing them for money....
next time manage throught the agent and steer clear of tenants on benefits...its not worth the hassle...its true pple say don't generalise but I have heard too many similiar stories and at the end of the day its you would will foot the bill of sorting this place out not the PC briadge...Good luck..learn from this experience..... |

If you can legally get them out, get them out. I let my house for 3 years whilst abroad, left it absolutely immaculate. Was an absolute tip,despite reassurances from the agents that it was in top order, they had some necessary work carried out to the shower in the en-suite, never seen such a cobbled together mess! congealed fat dripping from the kitchen cabinets, wrecked floor in the kitchen - they had redecorated though - despite the contract clearly stating that they couldn't. Had the big boss out from the agents and showed him the work that had been done - he sacked the plumber they use and I got a substantial amount back as they had returned every tennants security and it was difficult to prove who did what!
All you get told by agents is "they don't look after rented property like their own" I don't understand why, they must just live like pigs all the time! One lot of tennants even registered a business at the address! grrrrr! don't get me started!
It will only get worse, if you can not renew their contract that would probably be best, if you try and terminate the contract for breach, they will likely make even more of a mess before they leave!
I really feel for you, it's a horrible position particularly when you've left a spotless tidy house. I wouldn't do it again. |

You shouldn't have to get them out, get in touch with your letting agent [thats what you pay them for] and tell them that you want the current tenants out. No messing, be straight, and mean what you say, and they should do there job. Hope that this helps you. |

If they are paying well I think you would be best to just leave them there.
If you kick them out now you will probably do all the same repairs you will do if you leave them there for two years.
I take it from your language that you are in Britain. Here in Texas we are allowed to turn down people on government support (section 8) if we wish. We must have a consistent policy, and I do. I find the restrictions the government puts on the leases makes it very hard to evict anyone for any reason. |
