We found a house and wanted to make an offer. Our agent did a comparison and found a house less than two blocks away that was built by the same builder on the same street the exact floor plan with the exact square footage. The only differences were decorative, and the comp house had upgraded granite countertops and flooring and was one year newer. It sold one year ago. The house we want to put an offer on has carpet that is completely worn out. So we used the comparison of the other house that sold a year ago and factored in the replacement of flooring at a low price of three dollars a square foot. Instead of writing the offer our agent said that he called the listing agent and she told him that they would not take our offer and they shouldn't waste their time. This sounds very strange to me, what should we do? Do we insist that the offer is written and presented? We signed an agreement with this agent for 60 days can we get out of it? He doesn't seem to be acting in our best interest Additional Details I have emailed my agent stating that we still want to make the offer his response was that he has more news and will call me when he is free to discuss it. |

I don't know about anywhere else, but in Mo, an agent is required to present any contract the buyer wants to make. If the agent refuses to write your contract with your price, he has violated the agreement to represent you. Try being firm, but polite. If he still won't do it, you could talk to his broker or call the local Realtor's association if your agent is a member. The same goes for the seller's agent. He is required to present every contract submitted to him, whether he likes it or not. Neither of them knows what the seller will or won't take...the seller probably doesn't really know what he'll take until he gets an offer or two. |

most agents are bound by law to present an offer wheather they agree or not. Call the real estate board ask and complain.Here we don't sign agreements to keep an agent so we can use several at once if we choose..Only when we list do we sign agreements. Good luck |

Do you have an exclusive agreement with the realtor to find you a home? If so then they are legally and professionally required to write and present all offers to the listing agent and listing is required to present all offers to the seller.
If your realtor does not follow your instructions, you can send him and email and tell him why you want to cancel. You can also write to your local Realtor Association.

The problem doesn't really seem to be your Realtor; it seems to be the listing agent. Proceed with making an offer and having it presented. Your agent should insist that the offer be presented. Listing agents are required by law to present ALL offers, even ridiculous ones, to the homeowners. And, especially in this market, a listing agent that doesn't at least encourage owners to make a counter offer is a twit.
Of course, the info your agent has forthcoming might change your situation... Please update your question once you know what's going on. |

Wait! There are times when an agent may have inside knowledge about a particular property or builder, which could help you. However, even if your agent does have some knowledge, the fact that you asked the offer be written, they have violated their fiduciary duties to you as their client if they don't. You have given them a legal instruction, and they should comply. If the agent refuses, then I suggest you fire them immediately and seek help from their Broker. |

He works for you. If you can justify the offer then he should have made it.
Get a new agent once the sixty days are up. This agent doesn't sound that good.
Anyone can become a real estate agent. All it takes in most states is one class and an exam.

The problem dosn't lay with YOUR agent but with the listing agent. Have your agent write the offer and present it to the listing agent. By LAW the offer MUST be presented to the seller. Demand the offer be written and if it is rejected it will be signed by the seller and then presented to you. If you are unsure of your agent THEN you can tell him that you want out of the contract- if All else fails call his broker. |
