Already moved out and have deposit back?
I rented an apartment that was in pretty bad shape last year because I needed a place that would allow my dog. This year once my lease was up I was thrilled to move out. The landlord lives a few hours away and had requested for me to show it to new tenants. I posted it, made appointments, showed it, and directed candidates to him.

When I moved out I asked him when he wanted to see it to check it and give my deposit. He said he trusted me, asked for my new address and said leave the key on the counter. I did all that he mailed me my full deposit.

Now (two weeks later) I got an email regarding the bathroom shower curtain holder. I emailed him back that since the old one was leaking I set it up differently, which i had told him when i did it ( 6 months ago) and that is how it was when i showed it.

MY QUESTION: He hasn't yet responded, but what is protocol since I am out, I followed my lease, and someone else is there now, plus he didn't check it and gave me my security deposit back?

At the time I had to change it because it was leaking onto the apartment below me causing their light fixture, below my tub, to short circuit. Both me and the downstairs tenant told him this at the time it happened and he said he was glad we handled it ourselves. I literally only saw this landlord the day I signed the lease, he did not want to make the drive up here again as he is selling the building and does not care about the condition it is in.

You should check with your states landlord tenant laws. By him sending you back your deposit, he should have lost any claim to come after it for damages. In most states, the landlord has 30 days (some states is less) after he recieves possession of the apartment to make a list of repairs that he claims you are liable for along with any money that remains after repairs are done. If he fails to do so within 30 days, he loses his rights to keep the deposit.

My guess is he is out of luck since he already gave you back your deposit. In the future, always get things in writing with your landlord...even for something small. It can help you in the end should he or she try to come after you for something they say they didn't know about.
