MJ | Am I correct to ask my flat mate's girlfriend to leave? |
I moved into a flat about three months ago, with another flatmate. My flatemate had his girlfriend staying there, but he said she was going to be moving out after two weeks. It is three months on and she is still living here. Since she does not contribute to the bills, and doesnt help clean up I want her to leave. Am I in my right to kick her out? Our tenancy agreement states that no one else may live here apart from my flatmate and I. I am quite annoyed he has not consulted me about her staying here. |

yes, or at least get her to kick in her fair share of the bills. THe longer you wait the harder it will be. |

Tell your flatmate you'll only pay one third of the bills. If he has a problem with that then tell him either she needs to go or you're going to the landlord. Worst case scenario you may have to leave. Your flatmate sounds like a prick for making you support his girl. |

Since she was there when you moved in you should talk to your FM and try to resolve first. Is she moving and if not you can always talk to the landlord. If your FM isn''t wanting her to move then by all means get out of the lease. It is just going to get worse. I would be miffed too but i also wouldn't mess up a friendship if there is one. You never know a person until you live with them. |

Legally, you're in the right. I would say that you are also morally right too, however, you may want to consider whether you can afford the rent and bills yourself if he decides to choose her over you and moves out with her. |

Of course! ask gently but firmly. It will be better if you talk to your mate first. |

You are totally in the right. Your friend should be ashamed that you have to take this action. 3 Months is not 2 weeks. You have rights too. |

You have entered in to a deal without knowing the friend/mate. In case of your residence, business, personal life there can be no sharinglike this.Even after the friend's girl friend leaves, your relations stand strained. You should live alone or leave the flat. |

Well we don't need to be rude. You can talk to her about paying the bills but talk to your frind first. Say that she needs to kick in with helping a little bit because you all need to contribute to the rent adn living exspences. I mean if she doesn't, she has to move out. Don't be rude though. Just make it plain and simple. She helps with the bills or she is out. |

Hi there,
So am I right in thinking that the two of you moved in to the flat at the same time? Or did he live there first, with his girlfriend, then you moved in afterwards? If so, it's more tricky as my guess is that he thinks that you were fine about living with her in the first place. Either that, or he just doesn't care.
How close are you and your flatmate? Do you feel you can raise this with him and have a proper talk about it?
If you're not close and you don't mind tension, then you could always report it to the landlord if he won't discuss things with you.
If you are pretty good mates, it would be a shame for things to go sour. Could it be that your flatmate doesn't realise that you don't want his girlfriend living there? Maybe he thinks that you actually don't mind?
I think that you need to bring it up with him, in a tactful way. Even if you make a joke of it and ask when you two can have your Lads' Pad back again. If he's really close with his girlfriend, it will obviously upset him if you say that you don't like her or don't want her around.
To be fair, he should have spoken to you about it if you'd expected to live there alone with him. It's no fun living with a couple - I've been there (my best friend and her boyfriend - nightmare! He was a pain in the ***!!)
If you don't want to upset him, you can always say carefully that you like her, but you expected to live with just him and pretend that the problem is that it makes you uncomfortable to live with a couple, especially when you didn't expect to be doing so. You could always suggest that she stays living there only if you do a 3-way split on the rent - at least you'll be saving yourself some money.
If you speak to him and he's really rude about it or doesn't bother to talk to you, then you have a couple of options really. Either report him to the landlord or move out and find another place to live. It depends how understanding he is and whether he wants his girlfriend to leave - if he doesn't, I doubt she'll be going anywhere, unfortunately..... In which case, say that you'll only pay a 1/3 of the bills and if they don't cover the other 2/3, the landlord will obviously start asking questions. Or you leave him to support his gf on his own and find someone more considerate to live with :-)

I was in this situation once.
AT THE VERY LEAST tell him it's time she pay 1/3 of everything, AND do 1/3 of the work.
If he because a dick about it, tell him she is not legally entitled to live there.
Expect a very stressful living situation after that, and if I were you, I'd have a lock on my bedroom door too. |

aaaarrrrhhhhhhhhhhhh> your a pig. Dude you have every right to ask, rather insist that she leave. Your flat mate may get a little bent over it but hey, he knows the stipulations of the lease doesn't he? Tell them if she stays expenses will have to be split three ways or your flat mate can pay her share. A 3/3 split or 2/1 split it's up to them. She probably brags to her friends about how she has two guys supporting her and doesn't have to lift a finger. |

He's a cheeky so and so. He knows he is in the wrong. Unfortunately you may find tackling him about the situation may put a strain or end your friendship, but you are in the right. She has to contribute somewhat (33%) if she is staying there - but you are in the right anyway to say you dont want her there - your landlord will enforce that lease if you have any problems. |

Your flat mates girlfriends not allowed to stay there if her name isn't on the tenancy agreement as this is a breach of contact as its subletting and not allowed.
Kick her out!!! |
