Am I liable if I have no lease?
I just moved out of an apartment in which my lease had expired 8 months prior. Am I liable for damages as if I was still in a lease even when he moved people in only 3 hours after I moved out?

Most leases go month to month after the original lease is over. Generally it will state that in the lease. For you to be liable there had to be an inspection upon your leaving and the next tenant would have to make a list of the damages prior to moving in or within a reasonable time.

You are liable for damages if they occurred while you resided there.

You are always liable for damages you caused to the property of another, lease signed or otherwise. It's irrelevant how quickly new tenants moved into the premises. The damages still exist and have devalued the property. Pay up.

If you did the damages, you are liable.

Legally and morally. The landlord should have done a walk through the house with you and documented the damages and compared them to the original walk through. If that didn't happen it may be hard for the landlord to prove that you created the damages.

But hey...if you caused the damages, you should pay for them. Why would you expect someone else to pay for it.

You will be liable for all the money the landlord paid to fix the place. Ask for copies of receipts. If he refuses go talk to the new tenants when the landlord isn't around (bring a six pack or a bottle of wine as a housewarming) and see if you can get them to confirm the lack of repairs.

but he should have notified you before anyone moved in if there was any damage. He can't come back later and say, there was damage after someone else moved in.

I always take pictures when I move out, get a newspaper and take a picture of it and then place that paper around and take pictures of everything, then you have the date on the paper and the paper in your pictures to show that that place was good when you left.
