My tenants of roughly 6 months had told me that the outside porch carpeting had gotten extremely wet and moldy after the long winter. One of them told me that her father would replace it for me for only the cost of the carpet. I was agreeable provided they contacted me with pricing information PRIOR to buying and completing the project. I have priced outdoor carpet before and for this small space maybe 5ft by 6ft. it would not be very pricey (19 cents to 49 cents a square yard). Yesterday he called to INFORM me that the carpeting project had been completed last weekend and she would be taking $90 of her rent for June because that is what it cost. I am livid, but do not want to respond in anger. Please help? Additional Details I did mistype (it was sq. ft, not sq. yd.) I saw this at Menards. I was expecting the total to be less than $50. |

It does sound as if your tenants are taking advantage of you. Ask nicely for a receipt, after all, you would need it for tax records regardless and see what they produce.
If they have been excellent tenants I wouldn't complain too loudly, but would let them know that, in the future, you need to know what repairs will cost, or you will get them done yourself. |

Tell your tenants that they did not follow your directions in getting the repair done. If they cannot provide you with a receipt, don't allow the rent deduction.
No need for anger, just tell them the way it is. |

Sorry... $0.49 a square yard for new outdoor carpeting? I don't believe it. Check the date on your catalog, the current year is 2008.
In any event, did you do all this in writing, as any wise landlord does?
Receipt or not, I would go to Lowe's or Home Depot or whatever your source is and get a xerox of the price tag and return it to them and tell them they are authorized to deduct the amount you quote only. It is YOUR house and YOU choose the carpet to be bought. |

Demand a receipt for taxes. Additional costs would be adhesive, rental for a carpet stretcher (if he used one), if he had to replace any material (wood) under the old carpet. The floor may have need to be worked on. I would check you figures again for the outdoor carpet 19-49 cents a square yard is darn cheap, I can't even get burlap for that. Maybe that was a sq. foot. I checked in the paper today and outdoor carpet turf type was $.59 a sq. foot which calculates to $5.31 a sq yd. Another thing is are they good renters and is it worth losing good renters over. Take it as a lesson learned contact her and tell her to include the receipt with the rest of her payment for the month. If she says she doesn't have it ask her where she purchased the materials and what day tell her you will contact them to get a copy. This way you know it actually cost $90 plus you can use the receipt for your taxes. |

Ask them to submit the receipt to you. Be nice and explain that you asked them to advise you prior to purchasing the cost, however, that being said and done $90 dollars is not that bad, once you've seen the receipt advise them to deduct it from their next months rent. This tenant saved you the time, money and hassle of having to replace it yourself. They might have even gotten a better quality carpet than you would have selected so they might have improved it somewhat.
You're just mad because they didn't wait for your permission, just let it go and be greatful they were willing to do it, most tenants would call you and bug you to do it. |

Tell her to jump in a lake. Unless you had this agreement in writing...she had no right to proceed with replacing the carpet without your approval. Time to get tough...tenants sense fear and will take full advantage of it. |

First, I would be glad to have tenants that lasted 6 months in some of my properties. But to your point, I do not allow deductions from the monthly rent by the tenant. Tenants assume you are filthy rich and will squeeze every penny out of any cash flow.
My response would be, "Thank you." Then the next time they want to do some "work" I'd send someone out to look at it, to confirm the tenants concern and to give me estimates. Then choose the best licensed and bonded professional to do the necessary work. You can hire people with references from the big box home improvement stores at competitive market rates. |

Your tenants clearly didn't listen to you.
Unfortunately, it is not legal to take unpaid rent out of the security deposit - you would have to take them to small claims court.
With that said, 19 - 49 cents a yard is incredibly cheap. I have never seen carpet that inexpensive. $3 a square foot is too much. It sounds like they padded the price.
I would let the tenants know that this is unacceptable and that they may not take that much money out of the rent. Let them know that failure to pay full rent can result in a fine (it is $15 in New Hampshire, not sure what it is where you are). If the rent goes unpaid for too long (3 months), it is grounds for eviction.
Now for a little reality... it may not be worth causing too many bad feelings over $90. Bad feelings could escalate and you could end up losing WAY more than $90.
I would let it go and figure out a way to take it out of their security deposit at the end (what -they didn't scrub the toilet? That costs $90 to bring in a professional cleaning crew!)
Type in "landlord statute (state name)" into Google and read up on what you can legally do in your state.
