Anybody know what my rights are in this case?
My current house is for sale. The estate agent brought people to view the house. They have then moved my electric fireplace and scratched the woodpanel the fire place is standing on. The scratches are pretty visible. I understand that the people should have a look around but damaging things was never mentioned. What are my rights in this case?

Potential buyers should always ask the owner and realtor if they can move anything to look closer.

Even though the potential buyers may be at fault for the damage, you still need to prove it to the court. Sure, you can sue the customers but you need to prove that they were the ones who caused the damage. And convincing a lawyer to accept your case will be even harder.

If it's possible, I'd go with a different realtor and see what happens. Otherwise, I think you're up a creek with no paddle.

take photos of the evidence...let the estate agent know, tell them you want them to pay for the damage & then find a new estate agent. They fu*ked up, they were not professional & they didnt do their job properly...the job you're paying them to do!

The Agent should never have let the people touch anything. You could ask them ( the Agent) to pay for any repairs. I expect they will deny anything happened, if they do you will have to leave it go.

There are 3 issues...

1. If someone damages something, they can be sued for the loss of value.
2. How to you calculate this loss? What is the value of an X year old plinth? How much of that value has been lost by a scratch?
3. Can you prove to a courts satisfaction that they caused the damage.

Utter a quiet swear word under your breath, try to minimise the scratches appearance, and then go and have a drink!

I certainly would bring it to the real estates attention.They shouldn't be moving anything,you are still the rightful owner.

You don't really have a leg to stand on as you can't prove anything. It is word against word.

What I would do however is go and see the estate agent. Get them round the house to see the damage. Tell them how unhappy you are at the unprofessional way they have handled it, and see what they say. You could always tell them that your taking your house to another estate agent and see what they say.

In the mean time, I suggest you try and repair or at the very least minimise the damage (after the estate agent has been round) and then tell the agent that no future visits are to occur unless you are present.

Moving an electric fireplace is not part & parcel of viewing a house. If there were questions about the fireplace, they should have been put to the agent and the agent then asks you for the answer before passing the information onto the other party.

Unfortunately, when selling your house you are opening up to scrutiny from the viewers. The agent however should be present to ensure that nothing is damaged or moved or taken. Clearly in this case, the agent didn't do a very good job.

It is possible that the agent is unaware of the incident if the agent was not in the room at the time, so also expect the agent to now know anything about it.
